Adopted: September 6, 2005 Effective: September 6, 2005 ORDINANCE 2005-35 ORDINANCE APPROVING A SPECIAL EXCEPTION FOR THE GOVERNOR'S SCHOOL WHEREAS, the Pulaski County School Board submitted an application for a special exception, under Section 402.3-6 of the Town of Pulaski Zoning Regulations, to place two mobile classrooms on the campus of the former Northwood Elementary School in preparation for the relocation of the Southwest Virginia Governor's School to that site; and WHEREAS, the subject property, located at 100 Northwood Drive, is zoned R-1 and is identified as Tax Map No: 072-140-0000-0025 and is recorded in Deed Book 123, Page 353; and -~- WHEREAS, erection or construction of a government building requires a special exception under Section 402.3-6 of the zoning regulations; and WHEREAS, after advertisement as required by law, the Planning Commission and the Town Council conducted a joint hearing on August 23, 2005, wherein the comments and concerns of the public were heard and the factors listed in Section 702.4-5 of the Town of Pulaski Zoning Regulations were considered by the Planning Commission and Town Council; and that the Town Council did consider and find as fact that the proposed use is compatible with surrounding uses, is consistent with the intent of the Zoning Regulations and of the Comprehensive Plan, is in the public interest, and will comply with all other provisions of law and ordinances of the Town of Pulaski; and WHEREAS, at the joint meeting of August 23, 2005, the Planning Commission recommended approval of the special exception with no further conditions attached, NOW THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in legislative session on August 23, 2005, that the application for a special exception by the Pulaski County School Board to locate two mobile classrooms on property identified as Tax Map No. 072-140-0000-0025 located at 100 Northwood Drive is approved upon the following conditions: 1) That within 12 months of the vacating of the structure at 100 Northwood Drive for a new Governor's School, the School Board must make a decision regarding removal of the mobile classrooms. 2) That the layout for the mobile classrooms as submitted in Attachment A is approved. 1 This ordinance is effective upon adoption and is hereby adopted this 6th day of September 2005 by recorded vote of the Town Council as follows: Jeffrey S.
