ORDINANCE 2005-30
AMENDMENT TO ORDINANCE DATED APRIL 20, 2002
PROVIDING FOR RULES AND REGULATIONS OF OAKWOOD AND PINEHURST
CEMETARIES
WHEREAS the efficient and financially sound operations and maintenance of Oakwood and
Pinehurst Cemeteries is considered by the Town Council of the Town of Pulaski to require
adjustments to the existing ordinance and deeming same to be compatible with the health, safety,
and general welfare of its citizens; and
NOW THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski that § 18-27
of the existing cemetery ordinance of April 20, 2002 shall be as follows:

A Trust for "perpetual care" having heretofore been established
and an agreement with purchasers of lots entered into prior to the
effective date of this ordinance, it is hereby directed that the Town
continue to follow this procedure, and that the percentage of the total
sale price established by the Town be deducted from each sale and
deposited in the perpetual care trust fund. The amount deducted from
each sale shall be seventy-five percent (75%) to be used for maintenance
and perpetual care of the cemeteries (Oakwood and Pinehurst) and the
remaining twenty-five percent (25%) shall be placed in the aforesaid
Trust for investment and for the purposes stated in the terms of said
Trust. Further, seventy-five percent (75%) of the income from the trust
shall be transferred annually to the general fund for the sole purpose of
maintenance and perpetual care of the cemeteries (Oakwood and
Pinehurst).
This ordinance is effective upon adoption and is hereby adopted this 19~' day of July, 2005 by the
duly recorded vote of Town Council as follows:
