ORDINANCE 2005-29
ORDINANCE APPROVING SALE OF APPROXIMATELY
5.28 ACRES MORE OR LE5S TO CONMAT GROUP, INC.
WHEREAS, the Town Council of the Town of Pulaski, Virginia has invested its funds and energies in
the development of a Town Business Park; and
WHEREAS, the Town Council has considered a letter of offer from Conmat Group, Inc., (hereinafter
referred to as "Purchaser") aready-mix concrete producer who wishes to establish an operating facility
within the Pulaski Business Park and said offer is consistent with the health, safety and general welfare of
the public and in keeping with the announced goals of the Town of Pulaski; and
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia that the
offer by Conmat Group, Inc. is accepted and the sale of 5.28 acres, more or less (more accurately to be
determined by survey) at $5000.00 per acre is authorized subject to a right of reversion to the Town of
Pulaski should the Purchaser not establish a permanent ready-mix concrete facility supplying James
Hardie Building Products, Inc. and others within one (1) year of the date of this ordinance and/or should
Purchaser cease to operate as such within five (5) years, and the Town of Pulaski receives a first (1St)
option to purchase the property at any time said property is offered for sale by Purchaser at a price not to
exceed Fair Market Value with the Town of Pulaski having the right to have Purchaser remove any and all
materials and/or structures at Purchaser's sole cost and expense. Further, the Town Attorney is authorized
to develop and negotiate a contract with the Purchaser upon such further terms and conditions as the
Town Manager shall approve and as are consistent with this ordinance.
This ordinance is effective upon adoption and is hereby adopted this 7th day of July, 2005 by
recorded vote of the Town Council of the Town of Pulaski as follows:
