Adopted: May 12, 2005 Effective: May 12, 2005 ORDINANCE 2005-23 Approval of Hardie Contract and Sale of 51.8 acres WHEREAS, the Town of Pulaski by and through the Town Council has deemed it consistent with the general health, safety and welfare and in the best interests of its citizens to develop to the fullest extent possible the Pulaski Business Park; and WHEREAS, the Town of Pulaski has invested public funds in readying a space suitable in the Pulaski Business Park for constructing a major industry within the Town Business Park; and WHEREAS, James Hardie Building Products, Inc., has made a commitment to the Town of Pulaski through its Letter of Intent dated January 27, 2005 and the Town of Pulaski by and through its staff and member of Town Council have negotiated an agreement for the transfer and sale of 51.8 acres within the Town of Pulaski upon the terms and conditions contained therein; a copy of which is attached hereto and expressly made a part hereof as if set forth herein; and NOW THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia following proper advertisement, public hearing and due consideration does hereby approve the execution of the Agreement attached hereto and made a part hereof transferring and selling 51.8 acres (more or less) within the Town of Pulaski Business Park to James Hardie Building Products, Inc., upon the terms and conditions contained therein and the Town Manager is hereby authorized to execute any and all documents necessary to accomplish the provisions of said agreement with such adjustments in language and exhibits as he determines are within the scope of the approval of said agreement by Council. This ordinance is effective upon adoption and is hereby adopted this 12~' day of 1VIay 2005 by the duly recorded vote of Town Council as follows: Jeffrey S.
