HomeMy WebLinkAbout2005-02Ordinance 2005-02 Ordinance Amending §406.1-2 of the Zoning regulations and Zoning Ordinance and Zoning Map Regarding Planning Conunission Case 2004-18ZA ~,- Adopted: January 4, 2005 Effective: January 4, 2005 Ordinance 2005-02 Ordinance Amending §406.1-2 of the Zoning Regulations and Zoning Ordinance and Zoning Map Regarding Planning Commission Case 2004-18ZA WHEREAS, The Town Council of the Town of Pulaski, Virginia has considered the best interests of the public and determined that it is consistent with the general welfare of its citizens to amend the Zoning Ordinance R-5 Planned Unit Development District to permit its use on 6.8519 acres adjacent to English Forest Road and Travis Lane designated as Planning Commission Case 2004-18ZA. WHEREAS, the Town. Council of the Town of Pulaski has considered the best interests of the community and its citizens and bases the following amendments to the Zoning Regulations and Zoning Ordinance and Zoning Map upon the public necessity, convenience, general welfare, and good zoning practices; and NOW THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session on the 4th day of January 2005 that §406.1-2 of the Zoning Regulations and Zoning Ordinance and Zoning Map of the Town of Pulaski are hereby amended to permit its use on 6.8519 acres adjacent to English Forest Road and Travis Lane designated as Planning Commission Case 2004-18ZA. The Zoning Map amended herein is attached hereto and expressly made apart hereof as if expressly set forth herein. This ordinance is adopted and is effective upon adoption the 4th day of January, 2005 by recorded vote as follows: Jeffrey S. Worrell -Aye Dan Talbert, Jr. - No Bettye H. Steger -Aye Lane R. Penn -Aye John T. Bolen - No Joel B. Burchett, Jr. -Aye THE TOWN OF PULASKI, VIRGINIA By: - Charles L. Wade, Mayor ATTEST: Patricia Cruise, Clerk of Council Motion to Approve -Planing Commission Case 2004-18ZA (Zoning Amendment) I move for the approval of the above listed case with the following conditions. Condition: # 1 Developer shall be responsible for 15% or $4500 whichever is less for any road improvement to that portion of English Forest Road connecting the proposed sub-division entrance to Grove Drive. Further that this condition shall only apply to such improvements as may be made within 36 months afthe starting date of the developer's project or March 1, 2005, whichever occurs first. In the event that no improvements are made to the right-of--way prior to March 1, 2008, the developer shall not be responsible for any portion of the roadway improvement costs. Condition: #2 That the Developer will provide written notice to such contractors, sub- contractors, building material providers, and utility providers as to the best method of entering the project area with the least disturbance and/or disruption of the surrounding neighborhoods. The method of ingress and egress shall be reviewed and approved by the Town of Pulaski Engineering Department. It is understood that enforcement of this condition is limited based on right of use. Condition #3 That the Developer shall make those improvements as detailed in their proposal dated November 2, 2004 with respect to the installation of utilities, roadways, curb & gutter, and the Home Owners Association as setforth with the extension of completion dates being extended 120 days from the date of approval by the Pulaski Town Council. ,~ ti ~ u~ oC ~~ - I, Patricia Cruise, Clerk of Council, certify that the foregoing Ordinance 2005- ~ 02, Ordinance Amending §406.1-2 of the Zoning regulations and Zoning Ordinance and Zoning Map Regarding Planning Commission Case 2004-18ZA at their regular meeting on January 4, 2005. .~~,..
