HomeMy WebLinkAbout2004-30Ordinance 2004-30 Special Exception for a Machine Shop ADOPTED: September 7, 2004 EFFECTIVE: September 7, 2004 ~~~ TOWN OF PULASKI, VIRGINIA ORDINANCE 2004-30 SPECIAL EXCEPTION FOR A MACHINE SHOP WHEREAS, John T. Back, owner and Roger Hurd and Grant Hurd, applicants submitted an application for a special exception under the conditions required by §410.3-12of the Town of Pulaski Zoning Regulations to locate a machine shop on the former location of the Virginia Oak Flooring plant on Pierce Avenue; and WHEREAS, the subject properties are zoned B-2 (General Business District) and are identified as Tax Map Numbers 072-026-0175-001, 002, 007 and 072-025-0000-002 through 014 as recorded in Deed Book 527, Page 24; and WHEREAS, a machine shop requires a special use under the conditions listed under §410.3-12 of the zoning regulations; and WHEREAS, after advertisement required by law, the Planning Commission and Town Council conducted public hearings on August 9, 2004 and September 7, 2004 respectively, wherein the comments and concerns of the public were heard and the factors listed in §702.4-5 of the Town of Pulaski Zoning Regulations were considered by the Planning Commission and Town Council; and that the Town Council did consider and found as a fact that the proposed use is compatible with the surrounding uses, is consistent with the intent of the Zoning Ordinance and of the Comprehensive Plan, is in the public interest, and will comply with all other provisions of law and ordinances of the Town of Pulaski; and WHEREAS, at its August 9, 2004 meeting, the Planning Commission recommended approval of the special exception with the conditions that: • Hours of operation would be from 8:00 a.m. to 9:00 p.m. • Parking must be off-street. • If there is a stockyard for materials, it must be to the rear of the structure. NOW THEREFOREbe it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on September 7, 2004, that the application of John T. Back, owner and Roger Hurd and Grant Hurd, applicants for a special exception to have a machine shop on properties identified as Tax Map Numbers 072-026-0175-001, 002, 007 and 072-025-0000-002 through 014, located on Pierce Avenue, as shown in Attachment A, is approved upon the following conditions: • Hours of operation would be from 6:00 a.m. to 12:00 p.m. • Parking must be off-street. • If there is a stockyard for materials, it must be to the rear of the structure. ~S ~ This ordinance is effective upon adoption and is hereby adopted this 7th day of September 2004 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: Jeffrey S.
