ORDINANCE 2004-28
ORDINANCE AUTHORIZING THE EXECUTION OF DEED CONVEYING LAND TO THE
NEW RIVER VALLEY AIRPORT COMMISSION
WHEREAS, the New River Valley Ai ort Commission has requested of the Town
Council of the Town of Pulaski, Virginia that the Council execute a deed containing the lands
comprising the New River Valley Airport; and
WHEREAS, the Town Council for the Town of Pulaski, Virginia has considered the facts
and determined that it is in the best interests of the citizens of Pulaski and its neighboring
jurisdictions belonging to the Commission; and
NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski,
Virginia that the Town Manager is hereby authorized to execute the attached deed conveying the
Town's interests in and tcrthe lands described therein to the New River Valley Airport
Commission. The attached deed is hereby made a part hereof as if expressly set forth herein.
This ordinance is effective upon adoption and is hereby adopted this 7~' day of
September, 2004 and is adopted by the duly recorded vote of the Town Council of the Town of
Pulaski, as follows:

THIS DEED is made and entered into this 22nd day of June,
2004, by and between the TOWN OF PULASKI, VIRGINIA, grantor and
party of the first part, and the NEW RIVER VALLEY AIRPORT COMMISSION
(hereinafter the "Commission") grantee and party of the second part;
W I T N E S S E T H
Recitals
1. Local governments of the New River Valley region have by
agreement of association constituted the Commission to provide for
the governance of an airport facility in the New River Valley, near
Dublin.
2. Local governments of the New River Valley have provided
by their agreement of association that the Commission have authority
to acquire and hold real property.
3. Local governments which are parties to the agreement of
association by which the Commission was established have, from time
to time, acquired real property and associated rights in the names

of the localities, but intended for use by or for the benefit of the
New River Valley Airport.
4. The local governments which are parties to the agreement
of association are satisfied that it is appropriate to vest legal
title in the lands which were acquired for airport purposes in the
Commission.
5. The undersigned locality has duly authorized the
execution of this instrument on behalf of the locality, for the
purpose of conveying title to the lands and associated rights which
Covenants of Title unto the grantee, all those lands lying and being
approximately two (2) miles north of the Town of Dublin, Pulaski
County, Virginia, which comprise the lands of the New River valley
Airport, in the Cloyd Magisterial District of Pulaski County,
Virginia, more particularly described as follows:
1. TRACT A (Dobyns), consisting of 3.79 acres acquired by
deed recorded June 30, 1958, in the Office of the Clerk
of the Circuit Court of Pulaski County at Deed Book 181,
Page 203;
2. TRACT B (Mebane), consisting of 36.72 acres acquired by
order entered August 4, 1958, recorded in the Office of
the Clerk of the Circuit Court of Pulaski County at Deed
Book 190, Page 399;
3. TRACT C (Hanks), consisting of 2.75 acres acquired by
order entered August 4, 1958, recorded in the Office of
the Clerk of the Circuit Court of Pulaski County at Deed
Book 190, Page 394;
4. TRACT D (Collins}, consisting of 60.26 acres acquired by
order entered February 15, 1960, recorded in the Office
of the Clerk of the Circuit Court of Pulaski County at
Deed Book 190, Page 14;
5. TRACT E (Collins), consisting of 61.51 acres acquired by
order entered February 15, 1960, recorded in the Office
of the Clerk of the Circuit Court of Pulaski County at
Deed Book 189, Page 529;
6. TRACT F (Dobyns), consisting of 1.00 acre acquired by
deed recorded June 30, 1958, in the Office of the Clerk
of the Circuit Court of Pulaski County at Deed Book 181,
Page 203;
7. TRACT G (Graham), consisting of 77.92 acres acquired by
deed recorded January 16, 1958, in the Office of the
Clerk of the Circuit Court of Pulaski County at Deed
Book 179, Page 206;
8. TRACT H (Collins), consisting of 32.35 acres acquired by
order entered February 15, 1960, recorded in the Office
of the Clerk of the Circuit Court of Pulaski County at
Deed Book 189, Page 529;

11. TRACT K (Dalton), consisting of 40.41 acres acquired by
order entered February 15, 1960, recorded in the Office
of the Clerk of the Circuit Court of Pulaski County at
Deed Book 189, Page 526;
12. TRACT L (Dalton), consisting of 17.83 acres acquired by
order entered February 15, 1960, recorded in the Office
of the Clerk of the Circuit Court of Pulaski County at
Deed Book 189, Page 526;
13. TRACT M (Milligan College), consisting of 57.85 acres
acquired by deed recorded October 24, 1966, in the
Office of the Clerk of the Circuit Court of Pulaski
County at Deed Book 236, Page 517;
14. TRACT N (Guthrie), consisting of 6.20 acres acquired by
deed recorded February 18, 1971 , in the Office of the
Clerk of the Circuit Court of Pulaski County at Deed
Book 265, Page 592;
15. TRACT O (Collins), consisting of 5.60 acres acquired by
deed recorded October 17, 1969, in the Office of the
Clerk of the Circuit Court of Pulaski County at Deed
Book 256, Page 480;
16. TRACT P (Dalton), consisting of 14.10 acres acquired by
deed recorded September 3, 1969, in the Office of the
Clerk of the Circuit Court of Pulaski County at Deed
Book 255, Page 507;
17. (Gallimore), parcel in the William Gallimore Subdivision
of 0.0023 acre acquired by deed recorded August 19,
1971, in the Office of the Clerk of the Circuit Court of
Pulaski County at Deed Book 270, Page 485;
18. Reserved rights of Sarah E. Moore regarding possible
damages for cutting or trimming trees on the Pulaski
County Fairgrounds conveyed by deed recorded September
28, 1970, in the Office of the Clerk of the Circuit
Court of Pulaski County at Deed Book 263, Page 81;
19. The avigation easement and all rights provided in the
agreement made with Thomas M. Dobyns, et al., recorded
in the Office of the Clerk of the Circuit Court of
Pulaski County October 15, 1979, at Deed Book 346, Page
617;
20. The avigation easement and all rights provided in the
agreement made with Prestera Trucking Company, Inc.,
recorded in the Office e.f the Clerk of the Circuit Court
22. The avigation easement and all rights prova.ded in the
agreement made with Clareric.e H. Hanks, et al., recorded
in the Office of the C'_erk of the Circuit Court of
Pulaski County September 28, X979, at Deed Fsook 346,
Page 296.
Consisting of 469 acres, more. or less
This conveyance is made subject to such easements, rights of
way, and other matters as l:~wfully, affect the propert-.y conveyed
herein and excepting and excluding conveyances iawft~ily made by the
grantor of any portion of the property described herein. It is the
intention of the grantor to convey by this deed all the right,
title, and interest of the grantor in and to lands and interests in
land in Pulaski County, Virginia, acquired for the use or benefit
of the New River Valley Airp.~rt and. all rights and privileges
appertaining or appurtenant to ~_hose lands unto the grantee, which
the grantor does hereby ba.rga.in., sell, grant., and convey to the
grantee.
