HomeMy WebLinkAbout2004-19Ordinance 2004-19 Granting a Special Exception to Keep Horses at 1740 Smith Lane ADOPTED: July 6, 2004 EFFECTNE: July 6, 2004 ~3 ~ .J TOWN OF PULASKI, VIRGINIA ORDINANCE 2004-19 GRANTING A SPECIAL EXCEPTION TO KEEP HORSES AT 1740 SMITH LANE WHEREAS, Perry and Cathy Kingg submitted an application for a special exception under the conditions required by Section 402.3-9 of the Town of Pulaski Zoning Regulations to keep horses on their property at 1740 Smith Lane; and WHERAS, the subject property is zoned R-1 (Residential District) and is identified as Tax Map Numbers 063-015-0000-001 and 012 through 033; 063-016-0000-013, 014; 063-015- 0000-008, 009, 010, 011; and 072-140-0000-OOSB, 006, 007, 008, 009; and WHEREAS, the keeping of horses and ponies in the R-1 District requires a special exception under the conditions listed under Section 402.3-9 of the zoning regulations; and WHEREAS, after advertisement required bylaw, the Planning Commission and Town Council conducted public hearings on May 10, 2004 and June 1, 2004 respectively, wherein the comments and concerns of the public were heard and the factors listed in Section 702.4-5 of the Town of Pulaski Zoning Regulations were considered by the Planning Commission and Town Council; and that the Town Council did consider and found as a fact that the proposed use is compatible with the surrounding uses, is consistent with the intent of the Zoning Ordinance and of the Comprehensive Plan, is in the public interest, and will comply with all other provisions of law and ordinances of the Town of Pulaski; and WHEREAS, at its May 10, 2004 hearing, the Planning Commission recommended approval of the special exception with the condition that the factors for keeping horses in the R-1 District as listed under Section 402.3-9, be met and maintained; NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regulax session on July 6, 2004, that the application of Perry and Cathy King for a special exception to keep horses on their property at 1740 Smith Lane is approved upon the condition that the factors listed under Section 402.3-9, as affixed to this ordinance as Attachment A, be met and maintained. This ordinance is effective upon adoption and is hereby adopted this 6~' day of July, 2004 and is adopted by the duly recorded vote of the Town Council of the Town of Pulaski, as follows: Bettye H.
