HomeMy WebLinkAbout2003-04 Ordinance 2003-04 Adoption of New Zoning Regulations With Amendments and Corrections ADOPTED: March 4, 2003 EFFECTIVE: March 4, 2003 `S~ .' c Y^ TOWN OF PULASKI, VIRGINIA ORDINANCE 2003-04 ADOPTION OF NEW ZONING REGULATIONS WITH AMENDMENTS AND CORRECTIONS WHEREAS, the Town Council of Pulaski, Virginia has reviewed the proposed zoning regulations and rnap received from the Planning Comnssion and has referred proposed zoning amendments to the Planning Commission,. and m addition has considered the comprehensive plan and amended same; and WHEREAS, the Town Council has considered the best interests of the community and bases the following ordinance has corrected) upon the public necessity, convenience, general welfare and good zonng practices; and BE I ~ ORDAIlVED by the Council of the Town of Pulaski, Virginia sitting in regular session the 4 day of March, 2003, that the attached "Zoning Regulations Town of Pulasla, Virginia" are hereby adopted as if expressly set forth herein. This ordinance is effective upon adoption and is hereby adopted this 4th day of March, 2003, by the duly recorded vote of the Town Council of the Town of Pulaski, as follows: Bettye H. Churches by right in ail business and residential districts The phrase "houses of worship" has been placed in all residential and business districts as a permitted use in the following locations: R-1 Section 401.2-4 Page 12 R-2 Section 402.3-1 Page 14 R-3 Section 404.2-5 Page 18 R-4 Section 405.2-5 Page 21 R-5 Section 406.2-5 Page 23 B-1 Section 409.2-25 Page 35 B-2 Section 410.2-47 Page 41 B-3 Section 411.2-22 Page 44 2. Recreational Vehicles-stored off-street and prohibited from occupancy R-1 Section 402.4-3 Page 15 R-2 Section 403.4-3 Page 18 R-3 Section 404.4-3 Page 20 R-4 Section 405.4-3 Page 22 3. Parking Lots-Page 71 Section 503.2-1 amended to read: "Ali parking areas except those serving one and two-family dwellings, shall be an all weather surface." Schedule of Fe®s-Council Shaii Set Fees a. Section 801.1 amended to read: "Each application for a special exception permit shall be accompanied by payment of a fee as set by Council."-Page 109 b. Section 801.2 shall be amended to read: "Each application for a hearing before the BZA for an administrative review for a variance shall be accompanied by payment of a fee as set by the BZA." (Council needs fo authorize a correction to this in the text. Section 802 "Fees Related to Amendments" shall be amended to read: ~, "Each application fee for an amendment to the zoning text or the zoning map (rezoning) shall be accompanied by a fee as set by Council." General Provlstons-Article 300-Front of Structure Must Face Front of Lot Page 10 Article 300, General Provisions, shall be amended to add a provision as follows: "Section 308-"The front of all structures must face the front of the lot." 7. Addition to Definitions-Section 1102-Page 115 Adding the fo{lowing definition as follows: 2 Cemetery-any land or structure used or intended to be used for the internment of human remains; the sprinkling of ashes or their burial in a biodegradable container on church grounds or their placement in a columbarium on church property shall not constitute the creation of a cemetery. No cemetery shall be established within 250 yards of any residence without the consent of the owner of the legal and equitable title of the residence; provided that subject to the foregoing if the location for the proposed cemetery is separated from any residence by a state highway, it may be established upon such location without the consent of the owner of such residence if it be not less than 250 feet from the residence at its nearest point thereto; provided such prohibition and restriction shall not apply where the tract of land intended for use as a cemetery is separated from any residence by a state highway and now contains a public or private burial ground and is not within the corporate limits of the town; and no cemetery shall be hereafter established, and no burial made in any part of any cemetery, other than a municipal cemetery, located within 300 yards of any property owned ~ any city, town, or water company, upon which or a portion of which are now located driven wells from which water is pumped or drawn from the ground in connection with the public water supply. Further a plat shall be provided with the application for a special exception for a burial within the aforesaid definition of cemetery and such plat shall be capable of being recorded in the Circuit Court of the County of Pulaski, Virgins Clerk's Office before said special exception, if approved, is effective. 9.
