RESOLUTION 2Q02-39
Amending the Route of the New River Trail in the Town of Pulaski
WHEREAS, efforts have been unsuccessful to obtain access to certain properties for the
purpose of constructing an extension of the New River Trail from its present terminus
near Xaloy to the vicinity of the train station at the First Street Parking Lot; and
WHEREAS, additional negotiations with property owners and/or Federal and State
regulatory agencies are not likely to be successful and will add further delay to a project
which is already approximately five years in the making; and
WHEREAS, state and Federal authorities will allow grant and/or bond monies to be
transferred or reallocated to other trail routes if appropriate easements can be obtained
and other regulations complied with;
NOW, THEREFORE, BE IT RESOLVED that the original route of the extension
known as Phase I be abandoned;
FURTHER, that Phase I funding sources be reallocated to a proposed Phase III route;
FURTHER, that a grant offer to assist in building Phase II from the train station to the
Cool Springs area be accepted;
• FURTHER, that previous action by Council to abandon Phase II and Phase III be
rescinded inasmuch as proposed Phase I acquisitions and environmental concerns cannot
be resolved in a timely manner;
FURTHER, that staff be directed to proceed with construction of Phase II inasmuch as
access was previously achieved by the administration in 2001 and no acquisition issues
remain;
FURTHER, that the administration be directed to negotiate easements for access for the
proposed Phase III and to return each such easement to Council for approval;
FURTHER, that purchase of properties only be considered if an easement cannot be
obtained and only upon supporting justification, all such proposed acquisition to be
returned to Council for approval;
FURTHER, upon construction of Phase II and subsequently, Phase III, that the Council
shall dedicate Phase II and Phase III to the Commonwealth of Virginia to be a part of the
New River Trail System and for the purpose of providing on-going maintenance. This
assumes that necessary easements have been acquired, that no environmental problems
are uncovered that negate construction and that work is authorized to proceed as
appropriate with regard to Phase III by State and Federal regulatory agencies.

This Resolution is effective upon adoption and is hereby adopted this 3rd day of
December, 2002, by recorded vote of the Town Council of the Town of Pulaski, as
follows:
