RESOLUTION 2005-07
RESOLUTION ADOPTING CONDITIONS AND
PROCEDURES FOR NEGOTIATIONS WITH RESPONSIBLE LOW BIDDER
WHEREAS, The Town of Pulaski acting through its Town Council has adopted
Ordinance 2005-07 permitting the Town Manager to take all actions necessary to grade a
site at the Pulaski Business Park; and
WHEREAS, the Town Council by Resolution 2005-06 has determined that bids received
in response to an Invitation To Bid were not in the best interest of its citizens or
consistent with the general welfare of the public and through said resolution canceled
and/or rejected said bids due to insufficient funds to meet the bids; and
NOW THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski
that the Town Manager is authorized to continue proceeding with attempts to secure
grading a site within the Pulaski Business Park by all means available including but not
limited to securing another Invitation To Bid on a competitive bid basis which shall
contain language in the Invitation To Bid and contract documents allowing the Town of
Pulaski to negotiate with the lowest responsible bidder, whose bid exceeds available
funds to obtain a contract price within available funds. The Following procedures and
conditions are hereby expressly approved for said negotiations:
"In the event that the lowest responsive bid exceeds available funds, the Town of
• Pulaski reserves the right to negotiate with the apparent low responsible bidder to
obtain a reduced contract price."
This resolution is adopted and is effective upon adoption the 8th day of February, 2005 by
recorded vote as follows:
