AUTHORIZING CONDEMNATION PROCEEDINGS
FOR A SANITARY SEWER LINE
ACROSS THE PROPERTY OF MARK ALAN APARTMENTS, INC.
WHEREAS, certain residences in the Peakland area of the Town of Pulaski do not have sanitary
sewer service; and, the Town Council has determined that a public need for such services exists;
and,
WHEREAS, the Town has obtained easements from various property owners for the construction
and maintenance of a sanitary sewer line to serve this area of the Town; and,
WHEREAS, the Town has made bona fide offers to purchase an easement for said sewer line
across property belonging to Mark Allen Apartments, Inc. but the property owner had declined to
respond to such offers;and,
WHEREAS, the Town Council has determined that a public need exists for an easement across
the property of Mark Alan Apartments, Inc. for the construction and maintenance of said sewer
line; and,
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Pulaski,
• Virginia, sitting in Regular Session on January 16, 1996, that
1. The Town Attorney is authorized and directed to file condemnation proceedings against the
property of Mark Allen Apartments, Inc. for an easement for the construction and maintenance
for a sanitary sewer line to serve the Peakland area, and to seek an immediate right of access for
such purposes; and,
2. The Town Finance Director is authorized to pay the sum of five hundred dollars ($500.00) into
the Circuit Court of Pulaski County in the manner prescribed by law, as the fair market value of
such easement, so that the Town may have immediate access to the property.
This resolution is effective upon adoption and adopted by duly recorded vote of the Town
Council of the Town of Pulaski, Virginia, on this 16th day of January, 1996 as follows.
