Home My WebLink About2006-17U Ordinance 2006-17 Release of Industrial Park Covenants Adopted: May 2, 2006 Effective: May2, 2006 • ORDINANCE 2006-17 RELEASE OF INDUSTRIAL PARK COVENANTS WHEREAS, the Town Council of the Town of Pulaski, has determined that development of the Pulaski Industrial Park is in the best interest of it citizens and the health safety and general welfare; and that the uses to which the Pulaski Industrial Park are now being used in our plan for development are increasingly more industrial in nature; and WHEREAS, the covenants and regulations recorded in the Clerks Office of the Circuit Court of Pulaski County, Virginia as Instrument Number LR2004006305 by the Town of Pulaski, Virginia (the "Covenants and Regulations") reserved the exclusive right in the Town of Pulaski through the Town Council of the Town of Pulaski, Virginia to waive and release said restrictions; and NOW THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, that the Covenants and Regulations, in the Town of Pulaski Industrial Park are hereby waived and released as to all existing and future landowners within the Town of Pulaski Industrial Park, including but not limited to James Hardie Building Products, Inc., Conmat Properties, L.C., Gregory General Contracting ("GGC"), Ground Vibration Consultants, Inc., ("GVC"), • Samuel F. Gregory, Jr., Patricia I. Gregory, Bobby D. Payne, Angela H. Payne and all existing and remaining unsold lots and future purchasers thereof. The Town Manager of the Town of Pulaski, Virginia is hereby authorized to execute and record any and all documents necessary to give full force and effect to this ordinance. This ordinance is effective upon adoption and is hereby adopted this 2nd day of May, 2006 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: Jeffrey S.
