ORDINANCE AMENDING THE ZONING REGULATIONS TO ADD
SCREENING REQUIREMENTS FOR BUSINESS DISTRICTS
WHEREAS, the Town Counci{ of the Town of Pulaski, Virginia has considered it to be in the
best interest of the public and determined that it is consistent with the general welfare of the
citizens to amend the zoning regulations to add screening requirements to the B-1 Local
Business District, B-2 General Business District, and B-3 Central Business District regulations;
and
WHEREAS, the Town Council of the Town of Pulaski, Virginia has considered the best
interests of the community and its citizens and bases the following amendments to the Zoning
Regulations and Zoning Ordinance upon the public necessity, convenience, general welfare
and good zoning practices; and,
NOW, THEREFORE be it ORDAINDED by the Town Council of the Town of Pulaski, Virginia
sitting in regular session this 17th day of June 2008, that Section 1100 of the Zoning
Regulations and Zoning Ordinance be amended by the addition of the definition of "screening"
and "substantial construction" as follows:
"Screening-A method of visually shielding or buffering one abutting or
nearby structure or use from another by fencing, walls, berms, or
• vegetation."
"Substantial construction-means construction of such strength, material,
and workmanship that the object will withstand all reasonable shock, wear,
and usage to which it will be subjected. (4VAC25-40-10)".
FURTHER, that the following section "Screening Requirements" be added: to the B-1 Local
Business District regulations as Section 409.6; to the B-2 General Business District regulations
as Section 410.6; and to the B-3 Central Business District regulations as Section 411.5 as
follows:
Screening Requirements
This district shall permit the display, for retail purposes, of merchandise if such
sale is otherwise permitted in this zone. This district prohibits the storage,
collection or accumulation of any goods, saleable or not, in outdoor areas unless
all the areas in which such goods exist are screened from public view by an
opaque obstruction at least eight (8) feet in elevation.
All screening required under this section shall be of substantial construction. No
fragile or readily flammable material such as paper, cloth or canvas shall
constitute a part of any screen, nor shall any such material be employed as an
adjunct or supplement to any screen.

• All screening required under this section shall be installed entirely within the lot of
record or the leased premises, whichever is applicable. The property owner,
lessee, developer and/or successor in title to a given property shall be
responsible for the installation of required screening and its perpetual
maintenance, as well as timely repair and replacement of all screening as
required by this section. A failure to install or adequately maintain the screening
shall be deemed a violation of this ordinance.
This ordinance is effective upon adoption and is hereby adopted this 17th day of June 2008 by
the duly recorded vote of the Town Counci{ of the Town of Pulaski, Virginia as follows:
