HomeMy WebLinkAbout93-02ORDINANCE N0. 93-2 - (~, AMENDING ORDINANCE N0. 91-2 TO ESTABLISH PROVISIONS FOR ADJUSTMENTS TO WATER AND TO LEAKS OR BREAKS ON PRIVATE PROPERTY ADOPTED: Jan. 5, 1993 EFFECTIVE: Jan. 5, 1993 ADDITIONAL SEWER .CHARGES RELATED -159- ORDINANCE NO. 93-2 AMENDING ORDINANCE NO. 91-2 TO ESTABLISH ADDITIONAL PROVISIONS FOR ADJUSTMENTS TO WATER AND SEWER CHARGES RELATED TO LEAKS OR BREAKS ON PRIVATE PROPERTY WHEREAS, the Town Council adopted Ordinance No. 91-2 on January 15, 1991 to provide for adjustments to water and sewer charges that are related to leaks or breaks on private property; and, WHEREAS, that original ordinance provided that, regardless of circumstances, a customer could only apply for and receive one such adjustment in any year; and, WHEREAS, the Ordinance Committee of the Council has determined that the water and sewer adjustment policy should be amended to allow for more than one sewer charge adjustment per year where the water lost through the leak or break has not been returned to the sanitary sewer system. NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, sitting in regular session on January 5, 1993, that: Section 1. Any customer of the Town of Pulaski, who wishes to receive an adjustment against the customer's water and sewer bill because of extraordinary circumstances, may request such adjustment, within 90 days of learning of the extraordinary circumstances, by making application to the Town Manager or his designee. Examples of such adjustments would include the following: a. Sewer CharcLe Adjustment Water line breaks or leaks on the customer's side of the water meter where such leak or break has resulted in a water consumption on the subject premises that is at least two times the average consumption for that premises during the preceding four months and where such water is not returned to the sanitary sewer system; filling of swimming pools where any water drained from the pool would not be returned to the sewer system and would not be a significant detriment to the environment; or other similar circumstances where a large volume of water which can reasonably be estimated by the Town has been consumed on the premises without entering the sanitary sewer system. This adjustment will not be available for ordinary domestic purposes such as lawn watering and the like. A customer may make application and may receive a sewer charge adjustment, in accordance with the provisions of this ordinance, more than once in any 12-month period. b. Water Charae Adjustment Water line breaks or leaks on the customer's side of the water meter where such break or leak has resulted in a water -160 - consumption on the subject premises that is at least two times the average consumption for that premises during the preceding four months. Such adjustment will not be available where the customer was, or should have been, aware of such break or leak and did not take reasonable steps to repair such break or leak. A customer may make application and may receive a water charge adjustment, in accordance with the provisions of this ordinance, only once in any 12-month period. Section 2. The Town Manager is hereby authorized to make an adjustment, in accordance with the provisions of this ordinance, of up to 100%, of the sewer charge levied for water consumed on the premises that has not been returned to the sanitary sewer system; and up to 50~ of the water charge for water lost on the premises due to a water break or leak on the customer's side of the water meter. More than one sewer charge adjustment may be approved for a customer in any 12-month period; but only one water charge adjustment may be approved for a customer in any 12-month period. Section 3. The Town Manager is authorized to promulgate reasonable rules and regulations to carry out the purposes of this ordinance. Section 4. This ordinance hereby supersedes and rescinds the provisions of Ordinance No. 91-2, adopted by the Town Council on January 15, 1991. Section 5. 4~ This ordinance is effective upon adoption and the Town Manager is hereby authorized to apply its provisions to utility bills issued on and after September 1, 1992. Section 6.
