Ordinance Awarding Certificates of Public Convenience and Necessity
For Taxicab Operations for
Calendar Year 1994

WHEREAS, the Town of Pulaski properly advertised for applications to provide taxicab
service in the Town of Pulaski, Virginia, during calendar year 1994; and
WHEREAS, the Town Council received applications from Blue and White Cabs, Inc. and
James Edward Aust t/a Jim Dandy Taxicab Service; and
WHEREAS, pursuant to proper notice, a public hearing was held on December 7, 1993
to determine the number of certificates of Public Convenience and Necessity which should be
issued and to determine which applicants, if any, should be awarded such certificates; and
WHEREAS, on December 6, 1993, the Ordinance Committee of the Town Council met
with the applicants to further discuss the pending applications;
NOW, THEREFORE, be it Ordained by the Council of the Town of Pulaski, Virginia,
sitting in regular session on December 21, 1993, that
1. A total of 30 certificates of Public Convenience and Necessity are needed to provide
• proper taxicab service in the Town of Pulaski, Virginia in the calendar year 1994;
2. The Certificates are hereby distributed as follows:
Blue and White Cabs, lnc. 12
Jim Dandy Taxi Cab Service (James Edward Aust) 12
Held for future issuance 6
3. The aforesaid Certificates of Public Convenience and Necessity are issued on the
following conditions:
a. The Certificates are not transferable without the prior consent of the Town
Council, and will be void upon purported transfer. A sale or transfer of a majority
portion of the stock of a corporate certificate holder will be deemed a transfer of
the certificates and subject to the same limitations.
b. These certificates are valid until December 31, 1994 unless sooner suspended
or revoked by the Town Council.
c. Each operator must maintain a temninal or taxicab stand in the Town of Pulaski
with parking for all vehicles and a waiting room for customers with public restroom
facilities.
d. The aforesaid waiting room, restroom facilities, and all vehicles must be
maintained in a clean and sanitary condition.
e. Each operator must see that its drivers are neat and clean in appearance and
personal hygiene.
• f. All inoperable vehicles must be stored within a completely enclosed building.
g. The outside storage of parts, tires, batteries, and other equipment is
prohibited.

h. The two cabs formerly owned by Deluxe Cabs must be transferred to Blue and
White no later than January 1, 1994 and repainted no {star than February 1,
1994.
i. No later than ten (10) days after purchase, all other vehicles of each taxicab
company must be painted in uniform colors ao that the cabs of such company are
easily identifiable as belonging to that particular cab company. The colors are to
be approved by the Town in advance so that there will be no conflict between the
colors used by different companies.
i. All personal property taxes, business license taxes, and monies of any kind
due and owing to the Town of Pulaski, Virginia must be paid in full when due.
Any such taxes or monies which are currently past due must be paid in full prior
to the issuance of these certificates, unless otherwise agreed by the Town.
k. Federal, state and local laws must be complied with at ail times while the
certi>'icates are in effect.
I. Any certificate will be void if the operator ceases operations or refuses to
furnish service to the public during the year.
4. Failure of a certificate holder to abide by the above conditions will be grounds for
suspension or revocation of the Certii•icate of Public Convenience and Necessity by the Town.
5. The Town Council reserves the right to suspend, revoke, or modify the Certificates of
• Public Convenience and Necessity for any good cause shown. The Council will be the sole
determiner of what constitutes good cause.
This Ordinance is adopted this 21st day of December, 1993 by duly recorded vote of the
Town Council as follows:
