HomeMy WebLinkAbout95-04r: ORDINANCE N0. 95-4 ALLOWING FOR THE JOINT ENFORCEMENT OF TOWN AND COUNTY DECALS • ADOPTED: tlarch 21, 1995 EFFECTIVE: April 1, 1995 • ORDINANCE NO.9b-4 ALLOWING FOR THE JOINT ENFORCEMENT OF TOWN AND COUNTY DECALS • BE IT ORDAINED, by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on March 21, 1995, that the owner or operator of any motor vehicle, trailer or semitrailer, is required to display on his/her vehicle a valid local license issued by the County of Pulaski, Virginia, ox the Town of Dublin, Virginia, or the Town of Pulaski, Virginia, provided that the owner or operator of such vehicle is required by the jurisdiction of situs as provided in Section 58.1-3511 of the Code of Virginia, 1950, as amended, to obtain and display such license. A violation of this ordinance shall constitute a misdemeanor, the penalty for which shall not exceed that of a Class 4 misdemeanor. A violation of this ordinance by the owner of such vehicle may not be discharged upon payment of a fine, except upon presentation of satisfactory evidence that the required license has been obtained. This Ordinance shall also grant authority to the Mayor to sign and execute the Compact and Agreement dated February 27, 1995 between the Board of Supervisors of Pulaski County, Virginia, the Town Council of the Town of Dublin, Virginia and the Town Council of the Town of Pulaski, Virginia. Graham, Mayor ATTEST: ~,c~ ~^ Rut Harrell Clerk of Council a4:decal - 300 - • COMPACT AND AGREEMENT THIS COMPACT AND AGREEMENT, made and entered into this~~-~ day of 1995, by and between the BOARD OF SUPERVISORS OF PULASKf COUNTY, VIRGINIA, the TOWN COUNCIL OF THE TOWN OF DUBLIN, VIRGINIA, and the TOWN COUNCIL OF THE TOWN OF PULASKI, VIRGINIA. WITNESSETH: The governing bodies of the jurisdictions which are party to this Compact and Agreement agree to require by ordinance in each of the party jurisdictions the owner or operator of any motor vehicle, trailer or semitrailer, to display on his/her vehicle a valid local license issued by the County of Pulaski, Virginia, or • by the Town of Dublin, Virginia, or by the Town of Pulaski, Virginia, provided that the owner or operator of such vehicle is required by the jurisdiction of situs as provided in Section 58.1-3511 of the Code of Virginia, 1950, as amended, to obtain and display such license. Each jurisdiction agrees to provide in its ordinance that a violation of the said ordinance shall constitute a misdemeanor, the penalty for which shall not exceed that of a Class 4 misdemeanor, and that a violation of the ordinance by the owner of the vehicle may not be discharged by payment of a fine, except upon presentation of satisfactory evidence that the require license has been obtained. The party jurisdictions further agree to require that all personal property taxes assessed by the County of Pulaski, Virginia, or the Town of Dublin, Virginia, • or the Town of Pulaski, Virginia, on any vehicle be paid before licensure of such vehicle by either the County of Pulaski, Virginia, or the Town of Dublin, Virginia, or the Town of Pulaski, Virginia. 1N WffNESS WHEREOF, this Compact and Agreement is signed this a2~ dy of ~ ~ ~'* ~ ~ 1995, by the Chairman of the Board of Supervisors of Pulaski County, Virginia, the Mayor of the Town of Dublin, Virginia, and the Mayor of the Town of Pulaski, Virginia, to signify approval of this Compact and Agreement by their respective governing bodies.
