WHEREAS, Pulaski Seventh Day Adventist Church has petitioned the Town Council to allow an encroachment of approximately ten feet onto the platted right of way of Fourth Street, NW, near its intersection with Henry Street; and, WHEREAS, the purpose of the construction is to construct a handicap ramp and cinder block retaining wall; and, WHEREAS, the encroachment would not affect the safety or convenience of pedestrians or motorists; and WHEREAS, a public hearing was held to consider the request, and in consideration of the representations made at the hearing, the Town Council has determined that it is in the public interest to allow the proposed encroachment; Now, therefore, be it ORDAINED by the Town Council, Town of Pulaski, Virginia, sitting in regular session on March 16, 1993, that the Pulaski Seventh Day Adventist Church, with property at the intersection of Henry Avenue and Fourth Street, NW, in the Town of Pulaski, Virginia, is hereby pemnitted to encroach upon the platted right of way of Fourth Street, NW, by approximately ten feet for the construction of a handicap access ramp to the church building and to construct a cinder block retaining wall with a guard rail, with a maximum height of 42 ", tapering to less than 12" near the street. Permission is granted upon the condition that the Church provide a certificate of liability insurance naming the Town as an additional insured, insuring against injury to personal property in the amount of $ 100,000 per incident/$ 300,000 aggregate coverage. Construction is to be in substantial conformity with plans and/or sketches submitted to the Town. This Ordinance is effective upon adoption this 16th day of March, 1993, and is adopted by duly recorded vote of the Town Council as follows: Charles D. Crispin Aye Andrew L. Graham ~,,~_ J. R.
