Ordinance Allowing Encroachment by Jefferson Mills
onto Lagrange Street
WHEREAS, Jefferson Mills has petitioned the Town Council to allow an
encroachment of approximately ten feet onto the platted right of
way of Lagrange Street, between West Commerce Street and an alley
that serves Jefferson Mills' loading dock; and
WHEREAS, the purpose of the encroachment is to construct a cooling
tower and fence; and,
WHEREAS, the encroachment would not affect the safety or convenience
of pedestrians or motorists; and
WHEREAS, a public hearing was held to consider the request, and in
consideration of the representations made at the hearing, the Town
• Council has determined that it is in the public interest to allow the
proposed encroachment;
Now, therefore, be it ORDAINED by the Town Council, Town of
Pulaski, Virginia, sitting in regular session on June 1, 1993, that
Jefferson Mills, with property on Lagrange Street, at West Commerce
Street, in the Town of Pulaski, Virginia, is hereby permitted to
encroach upon the platted right of way of Lagrange Street, by
approximately ten feet for the construction of a cooling tower and
fence.
Permission is granted upon the condition that Jefferson Mills
indemnify and hold the Town harmless for any alleged injury or
damages resulting from Jefferson Mills' use of the property related
to the subject encroachment and that Jefferson Mills also provide a
certificate of liability insurance naming the Town as an additional
insured, insuring against injury to persons or property in the amount
of 5100,000 per incident/5300,000 aggregate coverage.
It is also required that Jefferson Mills install a drain pipe under
the cooling tower's concrete slab to the satisfaction of the Town
Engineer and that Jefferson Mills also install chevrons on the
fence posts.
Construction is to be in substantial conformity with plans and/or
sketches submitted to the Town, a copy of which is attached to this
• ordinance.

• Jefferson Mills shall remove the cooling tower from the right-of-way
if it is ever abandoned.
The Town reserves the right to require that Jefferson Mills remove
the cooling tower and fence if it threatens the safety, health and
welfare of the public.
This Ordinance is effective upon adoption this 1st day of June,
1993, and is adopted by duly recorded vote of the Town Council as
