HomeMy WebLinkAbout94-40ORDINANCE N0. 94-40 Closing of an Undeveloped Right-Of-Way Between Floyd Lane and Allison Lane ADOPTED: December 20, 1994 EFFECTIVE: December 20, 1994 • .Z3/ t ~.- ...- {~ (('~~ BUU;;'~~'!~~PA~E~~U • ORDINANCE NO.94-40 CLOSING OF AN UNDEVELOPED RIGHT-OF-WAY BETWEEN FLOYD LANE AND ALLISON LANE WHEREAS, Mr. Roger Clark and Mr. Gordon Hodges requested that the Town close an undeveloped right-of--way between Floyd Lane and Allison Lane; and WHEREAS, the Town Manager submitted the proposal to all department heads for any comments; and WHEREAS, the Town held a public hearing on December 20, 1994 on said proposal after advertisement in accordance with law; and WHEREAS, it appears that the portion of public right-of--way under consideration has never been opened and the Town Council finds that it is in the best interest of the Town and its citizens to close and vacate the said right-of--way; and NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on December 20, 1994, that an undeveloped right-of- way between Floyd Lane and Allison Lane is hereby abandoned, closed, and vacated with title thereto if any be vested in the Town, being hereby quitclaimed without warranty from the centerline to adjacent property owners on each respective side; reserving, any and all utility or other easements which may exist in favor of the Town of Pulaski, its successors and assigns. There are EXCLUDED from this abandonment and quitclaim and RESERVED by the Town, any and all utility or other easements that may exist in favor of the Town, its successors or assigns. This Ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 20th day of December, 1994, as follows: John A.
