HomeMy WebLinkAbout95-18• ORDINANCE N0. 95-18 AMENDING ARTICLE 4 SECTION1(RR RURAL RESIDENTIAL DISTRICT) OF THE TOWN OF PULASKI, VIRGINIA ZONING ORDINANCE • ADOPTED: June 20, 1995 EFFECTIVE: July 1, 1995 • 259 • ORDINANCE N0.96-1B Amending Article 4 Section 1(RR Rural Residential District) of the Town of Pulaski, Virginia Zoning Ordinance WHEREAS, the purpose of the RR Rural Residential District is to provide for more spacious single-family residential areas and for areas not yet urban where agricultural uses are appropriate; and WHEREAS, Article 4 Section 1 provides the permitted uses in the RR Rural Residential District; and WHEREAS, current RR regulations allow modular homes, but not mobile homes. A modular home is defined as, "A movable or portable dwelling over 32 feet in length and over 20 feet wide, designed and constructed without a carriage or hitch, as a stationary house constructed for placement upon a permanent foundation, to be connected to utilities, for year-round occupancy. It can consist of one or more components that can be retracted when transported and subsequently expanded for additional capacity, or of two or more units separately transportable (such as the so-called "double-wide" mobile home), but designed to be joined and joined into one integral unit.'° and; WHEREAS, the Town initiated this request due to an amendment to state code that becomes effective July 1, 1995. This amendment makes it necessary to amend the Zoning Code so it does not set separate standards for "mobile or manufactured homesn and site- . built homes constructed to federal standards. Because the State code amendment only refers to the "agricultural district, the proposed language change only applies to the Town's RR (Rural Residential) district; and WHEREAS, after advertisement as required by law, the Planning Commission and Town Council held public hearings on June 12 and 20, 1995, respectively, wherein the concerns and comments of the public were heard; and WHEREAS, the Town Council finds that the recommendation of the Planning Commission promotes the health, safety, and general welfare of the general public and accomplishes the purposes set forth in the Code of Virginia, particularly Section 15.1-427 and promotes and is consistent with the other provisions of the Town's land use plans, ordinances and regulations. NOW THEREFORE, BE IT ORDAINED by the TOWN COUNCIL of the TOWN OF PULASKI, sitting in regular session on June 20, 1995, that: Article 4 Section 1.2 (1) of the Pulaski Zoning Ordinance is amended to read as follows: 1. Detached single-family homes; and, the placement of manufactured houses on a permanent foundation, on individual lots, subject to the development standards that are equivalent to those applicable to site-built single family dwellings within this district. • Article 11, Definitions, of the Pulaski Zoning Ordinance is amended to add the following: 1. Man ~fac ~rPd Hom or House. A structure constructed to federal standards, transportable in one or more sections, which, in the traveling mode, is eight • (8) feet or more in width and is forty (40) feet or more in length, or, when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and contains the plumbing, heating, air conditioning, and electrical systems contained therein. This ordinance is effective as of July 1, 1995 and is adopted by this recorded vote of the Town Council of the Town of Pulaski, Virginia on this 20th day of June, 1995: John Johnston Aye Roy H.
