CLOSING OF SECOND STREET, S.E. FROM FLOYD AVENUE TO PIERCE AVENUE
WHEREAS, after studying the Town's system of streets and alleys to determine which streets
and alleys were unnecessary and should be closed, the Public Operations Committee of the
Town Council proposed to close Second Street, S.E. from Floyd Avenue to Pierce Avenue.
The Town of Pulaski will retain ownership of a section of the right-of--way 50 feet wide and
75 feet in length from Pierce Avenue west toward Floyd Avenue.
WHEREAS, the Town Manager submitted the proposal to all department heads for any
comments; and
WHEREAS, the Town held a public hearing on June 20, 1995 on said proposal after
advertisement in accordance with law; and
WHEREAS, it appears that the portion of public alley under consideration has never been
opened and that due to the topography it would not be possible to open said right of way in a
cost effective manner and the Town Council finds that it is in the best interest of the Town and
its citizens to close and vacate the said right of way; and
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski,
Virginia, sitting in regulaz session on July 18, 1995, that Second Street, S.E. from Floyd
Avenue to Pierce Avenue is hereby abandoned, closed, and vacated with title thereto if any be
vested in the Town, being hereby quitclaimed without warranty from the centerline to adjacent
• property owners on each respective side; reserving, any and all utility or other easements
which may exist in favor of the Town of Pulaski, its successors and assigns.
There are EXCLUDED from this abandonment and quitclaim and RESERVED by the Town, a
50 foot wide and 75 foot in length section of right-of--way from Pierce Avenue west toward
Floyd Avenue, any and all utility or other easements that may exist in favor of the town, its
successors or assigns. In particular, the Town reserves a drainage easement for any natural or
existing drainage course that runs across said right of way and alleys.
This Ordinance is effective upon adoption and is adopted by recorded vote of the Town
Council of the Town of Pulaski, Virginia, on this 18th day of July, 1995, as follows:
