HomeMy WebLinkAbout95-24Ordinane No. 95-24 • Closing of Fourth St. SE from Russell Street to Herron St. • ADOPTED: July 18, 1995 EFFECTIVE July 18, 1995 271 ORDINANCE 95-24 CLOSING OF FOURTH STREET, S.E. FROM RUSSELL STREET TO HERRON STREET WHEREAS, after studying the Town's system of streets and alleys to determine which streets and alleys were unnecessary and should be closed, the Public Operations Committee of the Town Council proposed to close the north 25 feet of Fourth Street S.E. from Russell Street to Herron Street. WHEREAS, the Town Manager submitted the proposal to all department heads for any comments; and WHEREAS, the Town held a public hearing on July 18, 1995 on said proposal after advertisement in accordance with law; and WHEREAS, it appears that the portion of public alley under consideration has never been opened and that due to the topography it would not be possible to open said right of way in a cost effective manner and the Town Council finds that it is in the best interest of the Town and its citizens to close and vacate the north ZS feet of the said right of way; and NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on Ju7.y 18, 1995 that the north 25 feet of Fourth Street, S.E. from Russell Street to Herron Street is hereby abandoned, closed, and vacated with title thereto if any be vested in the Town, being hereby quitclaimed without warranty from the centerline to the owners of Lot 36 on the north side of said street; reserving, any and all • utility or other easements which may exist in favor of the Town of Pulaski, its successors and assigns. There are EXCLUDED from this abandonment and quitclaim and RESERVED by the Town, any and all utility or other easements that may exist in favor of the town, its successors or assigns. In particular, the Town reserves a drainage easement for any natural or existing drainage course that runs across said right of way and alleys. The Town specifically retains as a public right-of--way, the southern 25 feet of said street, along lots 18-22. This Ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 18th day of July, 1995, as follows: John A.
