CLOSING A PORTION OF FIRST STREET, SW
BETWEEN MAPLE STREET AND VALLEY STREET
WHEREAS, after reviewing a request by Jefferson Mills to close a section of the
First Street, SW between Maple Street and Valley Street; and
WHEREAS, the Town Manager submitted the request to all department heads for
any comments; and
WHEREAS, the Public Operations Committee of the Town Council also reviewed the
request to close this section of First Street, SW; and
WHEREAS, the Town held a public hearing on December 5, 1995 on said request
after advertisement in accordance with law; and
WHEREAS, Town staff has analyzed the impact on traffic circulation and
determined that the level of service will remain at an acceptable level.
WHEREAS, Jefferson Mills submitted the request to facilitate a plant expansion
that would connect their two existing buildings on either side of First Street, SW;
and
• WHEREAS, Jefferson Mills projects that this expansion would include $1 million in
construction and $3 million in new machinery; and
WHEREAS, As a result of this expansion, Jefferson Mills will retain 388 jobs and
create 50 new jobs in the Town of Pulaski; and
WHEREAS, the Town Council finds that it is in the best interest of the Town and its
citizens to close and vacate the saidright-of--way; and
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski,
Virginia, sitting in regular session on December 5, 1995, that the section of the First
Street, SW between Maple Street and Valley Street is hereby abandoned, closed,
and vacated with title thereto if any be vested in the Town, being hereby
quitclaimed without warranty from the centerline to adjacent property owners on
each respective side; This abandonment is also conditioned upon the following:
1. Jefferson Mills is required to construct the plant expansion in substantial
conformity to the attached project description.
2. Jefferson Mills is responsible for negotiating with United Cities Gas Company
regarding the terms and cost of relocating the existing 4-inch gas line;
3. Jefferson Mills is responsible for negotiating with APCO regarding the costs and
• relocation of existing electrical lines and poles;

4. Jefferson Mills is responsible for checking all other easements held by others and
assume the responsibility for negotiating costs and relocation.
5. Jefferson Mills is responsible for the costs to relocate the existing 8-inch First
Street water line and to grant any easement necessary to reroute this water line
or other utility;
6. Jefferson Mills shall provide a project timetable that will allow sufficient time for
the Town to plan the water line relocation.
7. The Town will not be responsible for removing the existing road, curb, gutter,
electrical lines, poles, water lines or other infrastructure;
8. No road, curb, gutter, electrical lines, poles, water lines or other infrastructure
will be removed, relocated, demolished or otherwise changed until a building
permit for the plant expansion has been issued; and plant expansion construction has begun.
9. In order to keep the road open to traffic until construction begins, the effective
date of the street closing will be 14 days after a building permit is issued;
10. This abandonment is null and void unless a building permit for the expansion is
obtained within twelve months. This deadline could be extended by Town
Council if Jefferson Mills demonstrates that the delay was due to unusual or
. special circumstances.
There are EXCLUDED from this abandonment and quitclaim and RESERVED by
the Town, any and all utility or other easements that may exist in favor of the
Town, its successors or assigns.
This Ordinance is effective upon adoption and is adopted by recorded vote of the
Town Council of the Town of Pulaski, Virginia, on this 5th day of December, 1995,
as follows:
