HomeMy WebLinkAbout91-06ORDINANCE 91-6 • GRDINANCE CLOSING AN ALLEY IN BLOCKS 172 THE TOWN ADOPTED: March 5, 1991 EFFECTIVE: March 5, 1991 UNDEVELOPED and 173 OF -27- ORDINANCE NO. 91-6 ORDINANCE CLOSING AN UNDEVELOPED ALLEY IN BLOCKS 172 AND 173 OF THE TOWN WHEREAS, as shown on the 1908 Map of Pulaski, Virginia, prepared by C.E. Derrick, C.E., and recorded in the Office of the Clerk of the Circuit Court of Pulaski County, Blocks 172 and 173 of the Town were subject to a twenty foot alley running from Fifth Street S.E. across the platted Fourth Street to Stuart Avenue, parallel to Graham Street; and, WHEREAS, by Deed of Exchange dated October 18, 1955, recorded in Deed Book 170 at page 58, the Town of Pulaski vacated that portion of said alley which crossed Lot 3 of the C.N. Tester Subdivision in Block 172, but was granted an easement across the resubdivided Lot 3, as shown on a plat recorded in Plat Book 2 at page 179; and, WHEREAS, neither the original platted alley nor the relocated portion accepted as an easement have ever been developed or put into use by the Town; and, the adjoining landowners have petitioned the Town to vacate and close said alley and easement; and, • WHEREAS, after public notice and a public hearing as required by law, the Town Council finds that it is in the best interest of the Town and its citizens to close and vacate said alley and easement; NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on March 5, 1991, that the twenty foot alley running from Fifth Street S.E. across the platted Fourth Street to Stuart Avenue, parallel to Graham Street, as shown on the plat map attached hereto and made a part hereof, be and hereby is vacated, closed and abandoned by the Town. The Town hereby quitclaims any interest in the portion of the alley running from Stuart Avenue through Block 173 and into Block 172 to the North side of Lot 3 in Block 172, from its centerline to the respective abutting lotowners on either side; it being the Town's intention, insofar as it may do so, to quitclaim each such lotowner on either side, only that section of the alley necessary to extend each such lot to the center of the alley. This quitclaim is made without warranty of any kind as to the interest conveyed or as to the identity of any lotowner. The Town further quitclaims without warranty, to the present owner of Lot 3, Block 172, any interest in that easement or right of way reserved in Deed Book 170 at page 58, or in the alley itself, insofar as it has the power to do so. There are excluded from this abandonment and quitclaim, and reserved by the Town, • any and all utility easements that may exist in favor of the Town, its successors or assigns. aoo~ 049~Pa~E 6~~~; - z~ - BOQK O 4 9 ~.
