HomeMy WebLinkAbout91-23ORDINANCE N0. 91-23 `Pawn of Pulaski, Virginia • ADOPTING A SECTION 3 PLAN • ADOPTED: September 3, 1991 EFFECTIVE: September 3, 1991 • - 54 - • ORDINANCE N0. 91-23_ TOWN OF PULASKI, VIRGINIA ADOPTING A SECTION 3 PLAN WHEREAS, the Town of Pulaski has received a Community Development Block Grant from the Virginia Department of Housing and Community Development in the amount of $370,340 for the Cool Springs Neighborhood Improvements Project; and, WHEREAS, in order to comply with Section 3 of the Housing and Urban Development Act of 1968, the Town of Pulaski must adopt a Section 3 Plan; and WHEREAS, the Section 3 Plan requires that the Town shall utilize businesses and lower income residents of the Section 3 Project Area in carrying out the Cool Springs Neighborhood Improvements Project; and WHEREAS, the Town of Pulaski designates as its Section 3 covered project area the boundaries of the Town of Pulaski and Pulaski County. NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on September 3, 1991, that the Town Council, in accordance with Virginia Community Development Block Grant requirements, hereby adopts a Section 3 Plan. • This Ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 3rd day of September, 1991, as f ollows: C. The Town of Pulaski designates as its Section 3 covered project area the boundaries of the Town of Pulaski and Pulaski County; and, 2. In using Community Improvement Grant Funds, the Town of Pulaski, its contractors, and designated third parties shall to the greatest extent feasible, utilize businesses and lower income residents of the Section 3 covered Project Area in carrying out all activities; and, Section 3 Project Area-Businesses 3. In awarding contracts for work and procurement of materials, equipment or services, the Tawn of Pulaski, its contractors, and designated third parties shall take the following steps to utilize businesses which are located in or owned in substantial part by persons residing in the Section 3 covered area: • {a) The Town of Pulaski shall ascertain Community Improvement Grant funded work and procurements. (b) The Town of Pulaski shall ascertain through various and appropriate sources, including the Southwest Times and the Roanoke Times and World News, the business concerns covered by Section 3 which are likely to provide materials, equipment and services related to Community Improvement Grant funded activities. (c) The identified business concerns shall be apprised of opportunities to submit bids, quotes or proposals for work or procurement contracts which utilize Community Improvement Grant funds. (d) To the greatest extent feasible, the identified businesses and any other project area business concerns shall be utilized in Community Improvement Grant funded activities. Section 3 Lower Income Residents 4. In the utilization of trainees or employees for Community Improvement Grant funded activities, the Town of Pulaski, its contractors, and designated third parties shall take the following steps to utilize lower income persons residing in the Section 3 covered project area: -56- (a} The Town of Pulaski, in consultation with its contractors, shall ascertain the types and number of positions for both trainees and employees which are likely to be utilized during the project funded by Community Improvement Grants. (b) The Town of Pulaski shall advertise the availability of such positions in the Southwest Times and the Roanoke Times and World News, with application information. (c) The Town of Pulaski, its contractors, and designated third parties shall be required to maintain a record of inquiries and applications by project area of residents who respond to advertisements, and shall maintain a record of the status of such inquiries and applications. (d} To the greatest extent feasible, the Town of Pulaski, its contractors, and designated third parties shall utilize lower income project area residents in filling training and employment positions necessary for implementing activities funded by the Community Improvement Grant. 5. In order to ascertain substantial compliance with the above affirmative actions and Section 3 of the Housing and Community Development Act of 1968, the Town of Pulaski shall keep, and require to be kept by contractors and designated third parties listings of all persons em loved and all procurements made through the implementation_ of activities funded by the Community Improvement Grant. Such listings shall be complete and shall be verified by state visits and interviews, crosschecking of payroll reports and invoices and through audits, if necessary. -57- I, Ruth A.Harrell, Clerk of the Council for the Town of Pulaski, Virginia, do hereby • certify that the foregoing ordinance No. 91-23 Adopting A Section 3 Plan (in regard to the Cool Spring Neighborhood Improvement Grant) is a true and correct copy as asopted by the Pulaski Town Council at their regular meeting on September 3, 1991. ~- Ruth A.
