ORDINANCE 96-30
AMENDING SECTION 10-80 OF THE TOWN CODE RELATING TO
UNAUTHORIZED USE OF PARKING SPACES RESERVED FOR
PERSONS WITH DISABILITIES
WHEREAS, the Virguua General Assembly made it unlawful for persons without qualifying
disabilities to park in disabled parking spaces in vehicles displaying disabled plates or placards
exc~t when transporting a person with a qualifying disability; and
WHEREAS, this amendment will aid in the effort to curb abuse of disabled parking privileges; and
WHEREAS, Town Council's Public Operations Committee met on November 14, 1996 and
unanimously recommended that Town Council adopt these changes so disabled parking spaces
remain available for legitimate users.
NOW, THEREFORE, sitting in regular session on December 3, 1996, that:
1. Section 10-80 of the Pulaski Town Code shall be amended to read as follows:
a. It shall be unlawful for a vehicle not displaying disabled parking license plates, an
organizational removable windshield placard, a permanent removable windshield placard, or a
temporary removable windshield placard issued under § 46.2-739, to be parked in a parking space
• reserved for persons with disabilities that limit or impair their ability to walk.
b. It also shall be unlawful for a person who is not limited or impaired in his ability to walk to
park a vehicle in a parking space so designated except when transporting a person with such a
disability in the vehicle.
c. A fine of $250 will be assessed for a violation, notwithstanding any other provision of law.
d. A summons or parking ticket for the offense may be issued by law-enforcement officers and
other uniformed personnel employed by the Town to enforce parking regulations without the
necessity of a warrant being obtained by the owner of the private parking area.
e. The owner of any privately owned shopping center or building shall have sole responsibility
for furnishing, erecting or placing any necessary signs for such spaces.
This Ordinance is effective upon adoption this 3rd day of December,1996, and is adopted by duly recorded
vote of the Town Council as follows:
