HomeMy WebLinkAbout97-22C, Ordinance No. 97-22 Ordinance approving Charter changes relating to the authority of the Town Manager and requesting the Virginia General Assembly to make such changes Adopted December 17, 1997 Effective December 17, 1997 496 • Ordinance No. 97-22 ORDINANCE APPROVING CHARTER CHANGES RELATING TO THE AUTHORITY OF THE TOWN MANAGER AND REQUESTING THE VIRGINIA GENERAL ASSEMBLY TO MAKE SUCH CHANGES WHEREAS, the Pulaski Town Charter currently provides that department heads be appointed directly by the Town Council; and WHEREAS, the Charter also provides that the Town Manager should direct and supervise such department heads, even though appointed by Council, and makes the Town Manager responsible for the supervision of such department heads; and WHEREAS, after an analysis and study of the operations of the Town, the Town Council has determined that the existing provisions lead to confusion as to chain of command and authority and interfere in the daily operations of the Town; and • WHEREAS, a Public Hearing was held after at least ten (10) days notice as required by law on the proposed Charter changes; NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Pulaski Virginia, that the Town Council does hereby approve changes to the Charter of the Town of Pulaski which would allow the Town Manager, unless otherwise provided by general law, or Ordinance or Resolution of the Town Council, to appoint all officers and employees of the locality, including department heads. IT IS FURTHER ORDAINED that the Town Council does hereby request the Virginia General Assembly to make the necessary, changes. to the Town Charter to accomplish that purpose. In furtherance and not in limitation of this request, the following changes are requested: Section 4.02 Powers and duties of the town manager. Insert, in paragraph 1, after "except as provided by law" the phrase "ordinance or resolution of the town council,". • 497 ~~ ~ Section 4.02 Powers and duties of the town manager. Delete, in paragraph 2, "even though appointed by Council". Delete "the town manager can discipline the department heads and relieve them from their duties, provided that he reports any action taken against department heads to the town council before or at the next regularly scheduled meeting of the town council. He shall also have the duty to pass on to the council any information which he has relevant to an appointed official's fitness or ability to hold office, and to make appropriate recommendations concerning the appointment, removal or discharge of any such official." Section 5.02 Direction by Town Manager. Delete "and administered by an official appointed by the Town Council and subject to the direct supervision of the manager'. Section 5.03 Employment and Removal of the Department Heads. Substitute "town manager "for "town council" or "council". This Ordinance is effective on adoption and is adopted by duly recorded vote to the Town Council in Special Session on December 17, 1997 as follows: James M. Neblett Aye Lane R. Penn Aye Bettye H.
