HomeMy WebLinkAbout96-24Ordinance 96-24 Ordinance Allowing Right-of-Way Encroachment By Robert Collins to Install Handicap Ramp on Monroe Ave. • Adopted: August 20, 1996 Effective: August 20, 199 • 366 q~4s~~ • ORDINANCE 96-24 ORDINANCE ALLOWING RIGHT-OF-WAY ENCROACHMENT BY ROBERT COLLINS TO INSTALL HANDICAP RAMP ON MONROE AVENUE WHEREAS, Robert Collins petitioned Town Council to allow aright-of--way encroachment for the construction of a handicap ramp at his residence at 625 Monroe Avenue in the Town of Pulaski; and, WHEREAS, Robert Collins has steps from Monroe Avenue to his residence at 625 Monroe Avenue and desires to install a handicap ramp and has requested permission to place a handicap ramp that will extend approximately 7 feet into the right-of--way and be approximately 5 feet wide; and, WHEREAS, a public hearing was held to consider the request, and in consideration of the representations made at the hearing, the Town Council has determined that it is in the public interest to allow the proposed right-of-way encroachment; NOW, THEREFORE, be it ORDAINED by the Town Council, Town of Pulaski, Virginia, sitting in regular session on August 20, 1996, that Robert Collins is hereby permitted to encroach over the platted right-of--way at 625 Monroe Avenue to construct a handicap ramp. Construction is to be in substantial conformity with plans and/or sketches submitted to and approved by the Town Engineer; and, This permission is revocable at any time by the Town and is subject to the proviso that the Town will not • be responsible for any loss or damage to said ramp by reason of the public use or maintenance of the street and walkway; and, if the ramp is damaged by street or utility repair or replacement by the Town, the cost of repair to the ramp will be on the property owner. This Ordinance is effective upon adoption this 20th day of August, 1996, and is adopted by duly recorded vote of the Town Council as follows: John A. Johnston -Absent Charles W.
