HomeMy WebLinkAbout96-25• ORDINANCE 96-25 Ordinance Allowing Right-of-Way Encroachment By Pulaski Furniture Corporation to Install Wiring in Town Street and Walkway on North Madison Avenue • Adopted: August 20, 1996 Effective: August 20, 1996 • 1 J.~`1 Q~4 Sys ORDINANCE 96-25 ORDINANCE ALLOWINGRIGHT-OF-WAY ENCROACHMENT BY PULASKI FURNITURE CORPORATION TO INSTALL WIRING IN TOWN STREET AND WALKWAY ON NORTH MADISON AVENUE WHEREAS, Pulaski Furniture Corporation has entrances from North Madison Avenue to its manufacturing plant in the Town of Pulaski, and, WHEREAS, Pulaski Furniture Corporation petitioned Town Council to allow aright-of--way encroachment for the installation of a new system of automatic and semi-automatic gates; and is requesting permission from the Town to place wiring and sensors in the pavement of the street and walkway so that the presence of vehicles entering or leaving the gates will be electronically monitored; and, WHEREAS, a public hearing was held to consider the request, and inconsideration of the representations made at the hearing, the Town Council has determined that it is in the public interest to allow the proposed right-of--way encroachment; NOW, THEREFORE, be it ORDAINED by the Town Council, Town of Pulaski, Virginia, sitting in regular session on August 20, 1996, that 1. Pulaski Furniture Corporation is granted permission to install sensors and wiring for gate control purposes in the pavement of North Madison Avenue and its walkway, in accordance with plans approved • by the Town Engineer; and, 2. This permission is revocable at any time by the Town and is subject to the proviso that the town will not be responsible for any loss or damage to said system by reason of the public use or maintenance of the street or walkway; and, if the sensors are damaged by street or utility repair or replacement by the Town, the cost of repair to the sensor system will be on Pulaski Furniture Corporation. This Ordinance is effective upon adoption this 20th day of August, 1996, and is adopted by duly recorded vote of the Town Council as follows: John A. Johnston - ~,nt Charles W.
