ORDINANCE APPROVING A CONDITIONAL USE TO ALLOW A
5-UNIT APARTMENT BUILDING ON ELKINS AVENUE

WHEREAS, George E. and Jean C. Berryman, Agent for Richard Mansell and Carole Pratt, requested a
conditional use to construct a 5-unit apartment building on Elkins Avenue; and
WHEREAS, the subject location is caned R-2 (Residential) and the construction of an apartment building
requires a conditional use permit; and
WHEREAS, after advertisement as required by law, the Planning Commission and Town Council
conducted public hearings on May 13, 1996 and May 21, 1996, respectively; and
WHEREAS, the Planning Commission recommended approval with the conditions that, 1) a minimum
lot width variance be obtained from the Board of Zoning Appeals; 2) the water connection be made from
Pico Terrace, and 3) the developer be responsible for the sewer extension and that it be constructed to the
Town's standards for acceptance into the Town's system.
NOW THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting
in regular session on May 21, 1996, that the application of George E. and Jean C. Berryman, Agent for
Richard Mansell and Carole Pratt, for a conditional use permit to construct a 5-unit apartment building
on Elkins Avenue, as set forth in the application submitted to the Town is hereby approved as a
conditional use, with the conditions that, 1) a minimum lot width variance be obtained from the Board of
Zoning Appeals; 2) the water connection be made from Pico Terrace, and 3) the developer be responsible
for the sewer extension and that it be constructed to the Town's standards for acceptance into the Town's
system.
The use is subject to any other restrictions imposed by the R-2 caning district and any other applicable
laws and regulations.
This ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the
Town of Pulaski, Virginia, on this 21st day of May, 1996 as follows:
