HomeMy WebLinkAbout97-13• ORDINANCE N0. 97-13 Authorizing the Purchase of 88.1 Acres of Land from Bonnie Boothe for an Industrial Park • Adopted: August 19, 1997 EffectuveL August 19, 1997 • ~~~ N C~ Ordinance No. 97- 13 ORDINANCE AUTHORIZING THE PURCHASE OF 88.1 ACRES OF LAND FROM BONNIE BOOTHE FOR AN INDUSTRIAL PARK WHEREAS, the Town Council has determined that it is in the best interest of the citizens of the Town of Pulaski, Virginia to improve the economic base of the Town by developing an industrial park within the town limits; and, WHEREAS, the Town Council had been prepared to acquire such property by purchase if possible or condemnation if necessary; and, WHEREAS, as a result of negotiations conducted by the Town staff, an agreement has been reached for the purchase of 88.1 acres of land from Bonnie Boothe, lying in the Wurno area of the Town of Pulaski; and, WHEREAS, the aforesaid agreement cannot be binding upon the Town unless and until it is ratified in open session; NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town ofi Pulaski, Virginia, sitting in Regular Session on August 19, 1997, that_ 1. The Town Council does hereby ratify and approve a certain contract of sale dated August 19, 1997, between the Town and Bonnie Boothe, for the purchase of 88.1 acres of land and other rights as set out in said agreement; and, 2. The Town Attorney is authorized to search the title of said property, prepare documents, and do all other acts reasonably necessary to complete the purchase of said property; and, 3. The Town Manager and Clerk are authorized to execute documents, including but not limited to an assignment of a certain option agreement between the Town and Pulaski Properties, L.L.C. dated August 2, 1997, and 424 r- L • do all other acts reasonably necessary to complete the purchase of said property; and, 4. The Town Manager and Finance Director are authorized to draw and expend from UDAG funds the sum of four hundred thirty thousand dollars ($430,000.00) for the purchase of said property and/or for the acquisition of like kind property to be exchanged for the subject property, together with any sums needed to cover any closing costs.
