ORDINANCE AUTHORIZING THE PURCHASE
OF LAND FROM WILLIAM C. RHUDY, JR.
TO EXPAND THE TOWN INDUSTRIAL PARK
WHEREAS, the Town Council has determined that it is in the best
interest of the citizens of the Town of Pulaski, Virginia to improve the
economic base of the Town by expanding its industrial park; and,
WHEREAS, as a result of negotiations conducted by the Town staff,
an agreement has been reached for the purchase of 50 acres of land, more
or less, from WiNiam C. Rhudy, Jr., lying in the Wurno area of the Town of
Pulaski, contiguous to the 88.1 acres already purchased by the Town for an
industrial park; and,
WHEREAS, the aforesaid agreement cannot be binding upon the
Town unless and until it is ratified in open session;
NOW, THEREFORE, BE tT ORDAINED by the Town Council of the
Town of Pulaski, Virginia, sitting in Special Session on December 17, 1997,
that:
1. The Town Council does hereby ratify and approve a certain contract of
sale dated December 17, 1997, between the Town and William C. Rhudy,
Jr., for the purchase of 50 acres of land, more or less, and other rights as
set out in said agreement; and,
2. The Town Attorney is authorized to search the title of said property,
prepare documents, and do alf other acts reasonably necessary to complete
the purchase of said property; and,
3. The Town Manager and Clerk are authorized to execute documents and
do all other acts reasonably necessary to complete the purchase of said
property; and,
4. The Town Manager and Finance Director are authorized to draw and
expend from UDAG funds the sum purchase price of said property as
determined by survey, at four thousand eight hundred eighty one dollars

($4881.00) per acre, in three (3) installments as set forth in said contract, for
the purchase of said properly, together with any sums needed to cover any
closing costs. Notwithstanding the fund used, the payment obligation is
deemed a general obligation of the Town. The Council reserves the right to
redesignate the source of funds for any payment, in whole or in part, prior to
disbursement of such payment.
This Ordinance is adopted by duly recorded vote of the Town Council
on December 17, 1997 as follows:
