• IMPOSING THE FEE OF TWENTY DOLLARS (520.00) FOR BAD CHECKS TO THE
TOWN OF PULASKI, VIRGINIA
WHEREAS, Section 15.2 -106 of the Code of Virginia, as amended, authorizes
localities to provide for a fee, not exceeding the amount of twenty dollars ($20.00), for
the uttering, publishing or passing of any check or a draft for payment of taxes or other
sums due, which is subsequently returned for insufficient funds or because there is no
account or the account has been closed; and
•
WHEREAS, the Town of Pulaski currently imposes such a fee in the amount of ten
dollars ($10.00); and
WHEREAS, the Town's administrative cost in handling such checks exceeds the
statutory amount and the Town Council has determined that it be appropriate to impose
the maximum fee allowed by law;
NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski,
Virginia, sitting in regular session on July-'1zti998, that there hereby is imposed a fee in
the amount of twenty dollars ($20.00), for the uttering, publishing or passing of any
check or draft for payment of taxes or other sums due to the Town of Pulaski, which is
subsequently returned for insufficient funds because there is no account or the account
has been closed.
The imposition of this fee shall be civil nature and in no way shall be deemed to waive
the right of the Town to proceed to take criminal warrants against any person who
violates any criminal statute relating to the passing, making, or uttering of bad checks
or any other similar criminal law.
This Ordinance is effective as to checks received by the Town on or after July 15, 1998.
This Ordinance is adopted by recorded vote of the Town Council as follows:
