ADOPTED: June 20, 2002 EFFECTIVE: June 20, 2002 7~ ~ J • • ORDINANCE 2002-09 ORDINANCE FOR THE ABATEMENT OF LEVLES ON BUILDING RAZED, DESTROYED OR DAMAGED BY FORTUITOUS HAPPENINGS WHEREAS, the Pulaski Town Council sitting in special session has determined that it is consistent with the public interest and general welfare to adopt an ordinance consistent with the 1950 Code of Virginia, as amended, to abate levies on buildings razed, destroyed, or damaged by fortuitous happenings; and WHEREAS, the Pulaski Town Council sitting in special session has advertised in accordance with law for a public hearing on June 20, 2002, wherein the comments of the public were received concerning abatement of levies on building razed, destroyed, or damaged by fortuitous happenings; and NOW THEREFORE BE IT HEREBY ORDAINED that pursuant to Section 58.1- 3222 of the 1950 Code of Virginia, as amended, tax levies shall be abated on building which are (1) razed, or (2) destroyed or damaged by fortuitous happenings beyond the control of the owner. No such abatement, however, shall be allowed if the destruction or damage to such building shall decrease the value thereof by less than $500.00, and no such abatement shall be allowed unless the destruction or damage renders the building unfit for use and occupancy for thirty days or more during the calendar year. The tax on such razed, destroyed or damaged buildings is computed according to the ration of which the portion of the year the building was fit for use, occupancy and enjoyment bears to the entire year. Application for such abatement shall be made by or on behalf of the owner of the building to the Director of Finance within six months of the date on which the building was razed, destroyed, or damaged.
