HomeMy WebLinkAbout98-27 Ordinance No. 98-27 Authorizing the purchase of Pulaski Business Plaza (Maple Shade Shopping Center) and an additional parcel in the same block, shown on the Town tax maps as lots 072-140-000- 160B, 072-020-000-1, 1a and 2 and a R/W with turnaround, all described in DB 465, page 686 • Adopted: December 28, 1998 Effective: December 28, 1998 • ORDINANCE 98-27 • ORDINANCE AUTHORIZING THE PURCHASE OF PULASKI BUSINESS PLAZA (MAPLE SHADE SHOPPING CENTER) AND AN ADDITIONAL PARCEL IN THE SAME BLOCK, SHOWN ON THE TOWN TAX MAPS AS LOTS 072-140-0000-1608, 072-020-000-1, 1A, nNO 2 AND A RNV WITH TURNAROUND, ALL DESCRIBED IN DB 465, PAGE 686 WHEREAS: 1. The Town of Pulaski is interested in acquiring property in the Town of Pulaski known as Maple Shade Shopping Center and an adjoining parcel and right of way, for multiple public purposes, including but not limited to municipal use as well as economic development and Town revitalization; and, 2. By Ordinance 98-26, the Town accepted an offer whereby it will acquire a deed of trust and note on the shopping center; and, 3. By letters dated December 15, 1998 and December 22, 1998, and contract of December, 1998, Earle W. Greene and New River Properties, Inc., the owners • of the real estate offered to convey the shopping center and adjacent parcel to the Town in satisfaction of said deed of trust and note; and, NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in special session on December 28, 1998, that: 1. The acquisition of said shopping center and an adjacent parcel in the same block (known as the "gas station lot") and being shown on the Town tap records as LOTS 072-140-0000-1608, 072-020-000-1, 1A, ANO 2 AND A RNV WITH TOURNAROUND, ALL DESCRIBED IN DB 465, PAGE 686, is approved and the pending sales contract is approved and ratified; and 2. Upon receipt of a copy of the signed contract and completion of the negotiation of the note and deed of trust to the Town, the Town Manager or, in his absence, any Acting Town Manager, is authorized and directed to do all things reasonably necessary to complete this transaction, including but not limited to notifying the property owners forthwith that the Town accepts the offers contained in the letter of December 15 and 22, 1998 on the terms and conditions set forth therein and the subsequent contract; and authorizing the Town attorney or some other attorney designated by him to examine the title to said property; and scheduling a closing to occur in January, 1999; • S r 3. Upon receipt and recordation of general warranty deeds conveying said . property and transfer and assignment of any leases thereon and completion of the other terms and conditions set forth in said letter, the Town Manager or Finance Director is authorized and directed to mark said note satisfied and to release the deed of trust. This Ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on December 28, 1998, as follows: James M. Neblett AYe W.
