ORDINANCE APPROVING REZONING OF 1.08 ACRES
ON BOB WHITE BOULEVARD FROM R-1 (RESIDENTIAL)
TO B-1 (LOCAL BUSINESS DISTRICT)
WHEREAS, Ferd Harvey, Jr; Eugene W. Chumbley; and Lucas Construction and Development, Inc., James Lucas-president,
submitted a request to rezone 5.99 acres from B-1 (Local Business District) to B-2 (General Business District) for development of
businesses; and
WHEREAS, a 1.08 acre portion of a lot identified as Tax Map No. 073-001-0000-039 was zoned R-1 (Residential District) and does
not permit business activity; and
WHEREAS, after advertisement required by law, the Planning Commission and Town Council conducted public hearings on January
11, 1999 and February 2, 1999 respectively, wherein the comments and concerns of the public were heard; and
WHEREAS, the aforementioned applicants elected, during the public hearing before the Planning Commission, not to pursue zoning
of the original site to B-2 (General Business District), but to seek rezoning of the 1.08 acre portion of the lot identified as Tax Map
No. 073-001-0000-039, (which is bordered by Thornspring Branch, Newbern Road, and Bob White Boulevard) currently zoned R-1 to
B-1; and
WHEREAS, B-1 (Local Business District} is a less intensive use than B-2 (General Business District) so no additional advertisement
was required; and
WHEREAS, following the public hearing, the Planning Commission recommended approval of the rezoning of the 1.08-acre portion
of lot 073-OO1-0000-039 from R-1 (Residential District) to B-1 (Local Business District) as shown in the attached map.
NOW THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on February
2, 1999, that the amended application of rezoning a 1.08 acre portion of the lot identified as Tax Map No. 073-001-0000-039, which is
• bordered by Thomspring Branch, Newbern Road, and Bob White Boulevard, as recommended by the Planning Commission is hereby
approved.
The property is subject to any other restrictions imposed by the B-1 zoning district and any other applicable laws and regulations.
This ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on
this 2nd day of February 1999 as follows:

I, Patricia Pendergrast, Clerk of Council of the Town of Pulaski, Virginia do hereby
certify that the foregoing Ordinance No. 99-Z, approving rezoning of 1.08 acres on Bob
White Blvd, from R-1 to B-l, is a true and correct copy of the Ordinance set out and
adopted by the recorded vote of the Town Council on February 2, 1999.
