HomeMy WebLinkAbout2001-08• Ordinance 2001-08 Amending Article 4, Section 7.2 (Permitted uses in the B-3 Central Business District) of the Town of Pulaski, Virginia Zoning Ordinance • ADOPTED: June 5, 2001 EFFECTIVE: June 5, 200.1 • ~~" • ORDINANCE 2001-08 ORDINANCE AMENDING Article 4, Section 7.2 (PERMITTED USES IN THE B-3 CENTRAL BUSINESS DISTRICT) OF THE TOWN OF PULASKI, VIRGI1~lIA ZONING ORDINANCE. WHEREAS, the purpose of the B-3 Central Business District is to provide for an appropriate variety of uses in the historic center for commercial, financial, professional, governmental and cultural activities; and promote a convenient and relatively compact arrangement of uses and buildings; and WHEREAS, Article 4, Section 7.2 provides the permitted uses in the B-3 Central Business District; and WHEREAS, at its regular session on May 1, 2001, the Town Council referred the proposed amendment to the Zoning Ordinance to the Planning Commission; and WHEREAS, a use in compliance with the conditional use additions would be no more objectionable than other permitted uses in the B-3 (Central Business District) because the use would not create any hazardous, objectionable, or offensive conditions outside the building by any • source, including but not limited to odor, dust, smoke, cinders, fumes, noise, vibration, heat, glare, wastes, fire, or explosion and the use would be harmonious with such commercial uses in a significant respects, including but not limited to signage, traffic flow and exterior appearance; and WHEREAS, as a conditional use, the Planning Commission and Town Council shall review applications on a case-by-case basis and may attach reasonable conditions, if necessary, prior to the establishment of the use; and WHEREAS, after advertisement required by law, the Planning Commission and the Town Council held a joint hearing on May 21, 2001, after which the Planning Commission recommended approval of the ordinance amendments; and WHEREAS, after due consideration of the information before it was evaluated by appropriate zoning standards, the Town Council found that it is reasonable and suitable to amend the subject sections of the Pulaski Zoning Ordinance and that the recommendation of the Planning Commission promotes the health, safety, and general welfare of the public and accomplishes the purposes set forth in the 1950 Code of Virginia, as amended, particularly Sections 15.2-2200 and 15.2-2283, and promotes and is consistent with the other provisions of the Town's land use plans, ordinances and regulations. NOW, THEREFORE, be it ORDAINED by the COUNCIL of the TOWN OF PULASKI, VIItGINIA, sitting in regular session on June 5, 2001, that: 73 Section 1. Article 4, Section 7.2 of the Pulaski Zoning Ordinance is amended to include: Wholesale brokerage or storage establishments with floor area devoted to storage or warehousing of 20,000 square feet or more, as a conditional use, but not a truck or freight terminal. Light manufacturing, fabricating and processing operations within completely enclosed building which do not produce hazardous, objectionable, or offensive conditions outside the building by any source, including but not limited to odor, dust, smoke, cinders, fumes, noise, vibration, heat, glare, wastes, fire, or explosions so that nearby commercial uses in all significant respects, including but not limited to signage, traffic flow, and exterior appearance, as conditional uses. • • Section 2.
