HomeMy WebLinkAbout2001-16• Ordinance 2001-16 An Ordinance Permitting a Thirty Bed Expansion to the Pulaski Health Care Center at 2401 Lee Highway as a Conditional Use n U ADOPTED: October 2, 2001 EFFECTIVE: October 2, 2001 • ~~ • ORDINANCE 2001-16 AN ORDINANCE PERMITTING A THIRTY BED EXPANSION TO THE PULASKI HEALTH CARE CENTER AT 2401 LEE HIGHWAY AS A CONDITIONAL USE WHEREAS, Medical Facilities oftimerica, XIX, owners; and Fralin and Waldron, Inc., agents, submitted an application for a conditional use permit for a thirty bed addition to the Pulaski Healfh Care Cenfer located at 2401 Lee Highway in the Town of Pulaski, Virginia; and WHEREAS, Medical Facilities ofAmerica, XIX was issued a Medical Care Facilities Certificate of Public Need (VA-03528) by the Commonwealth of Virginia's Department of Health on July 11, 2000; and WHEREAS, the property is zoned R-1 (Low Density Residential District) and is identified as Tax Map No. 063-025-0000-027A as shown in Attachment A attached hereto and made a part hereof as if expressly set forth herein; and WHEREAS, in the R-1 District, the proposed activity is adjudged as requiring a conditional use permit according to the zoning regulations of the Town; and • WHEREAS, after advertisement required by law, the Planning Commission and Town Council conducted public hearings on August 13, 2001 and September 4, 2001 respectively, wherein the comments and concerns of the public were heard; and WHEREAS, at its August 13, 2001 meeting, the Planning Commission recommended approval of the conditional use with conditions; NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session on October 2, 2001, that the application of Medical Facilities ofAmerica, XIX, owner; and Fralin and Waldron, Inc., agent; for a conditional use to add a thirty bed addition to the Pulaski Health Care Center at 2401 Lee Highway, identified as Tax Map No. 063-025-0000-027A, is hereby approved with the following conditions: 1. That the buffer of trees shall be maintained (trees trimmed) by the developer. Said buffer of trees extends along the property line of the subject property, identified as Tax Map No. 063-025-0000-027A ,and adjacent properties identified by Tax Map Numbers as follows: 063-025-0000-027C; 063-025-0000-060; 063-019- 0000-001; and 063-019-0000-024. Any trees that fall shall be removed by the developer within 10 days. • 2. That the proposal for litter control in Fralin and Waldron's letter of August 28, 2001 to Mrs. Ruth Ellans (Attachment B )and Mr. and Mrs. H.D. Coltrane ~~ • (Atttachment C) attached hereto and expressly made a part hereof, be made a condition of this ordinance as follows: a. Medical Facilities of~Imerica, XIX and Fralin and Waldron would first attempt to correct the litter problem through communication between staff and visitors. Notices are to be given to all employees that the parking areas are to be kept litter free. Another trash receptacle will be placed in the parking area along with "no littering/pitch in" signs. Staff will monitor the area for compliance. Should this approach not work, Medical Facilities ofAmerica, XIX andFralin and Waldron will construct a "permanent structural barrier" as recommended by the Planning Commission, specified as a six foot high chain link fence described in the letter of August 22, 2001 (Attachment D) attached hereto and made a part hereof as if expressly set forth herein. This use is subject to other restrictions imposed by the R-2 zoning district and any other applicable laws and regulations. This ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia on this 2nd day of October, 2001 as follows: Jeffrey S.
