HomeMy WebLinkAbout06-20-00Minutes of the Town Council meeting held June 20, 2000 at 5:00 p.m. in the Council Chambers in the Municipal Building. There were present: John A. Grubb Charles Wade Woody Lookabill Michael Dowell Lee Carter, Press Tina Ratliff, Press Paul Dellinger, Press Mayor Johnston called the meeting to order at 5:00 p.m. Councilman Worrell led the Pledge of Allegiance and Councilwoman Steger gave the Invocation. Following roll call, Councilman Weddle made a motion to adopt Certification Resolution for closed session held before Council meeting on 2.1-344 (A-7), consult with legal counsel, seconded by Councilwoman Steger and carried on the following recorded vote: James M. Neblett - Absent Daniel Talbert, Jr. - Aye Lane R. Penn - Aye Joseph L. Weddle - Aye Jeffrey S. Worrell - Aye Pauline G. Mitchell - Aye Bettye H. Steger - Aye Charles W. Stewart, Jr. - Aye First item on agenda was the swearing in of the newly elected Council members and Mayor. R. Glenwood Lookabill administered an oath of office to the officers elected at a regular Municipal Election, held for the Town of Pulaski, Virginia, on May 3, 2000. These officers were elected with terms to begin July 1, 2000: Mayor Charles W. Stewart, Jr. – two year term Pauline G. Mitchell, E. G. Black, Jr., Kenneth M. Fleenor, Council members to serve four years. Also re-elected to Town Council in May was Councilman James M. Neblett. Due to his absence, he was not sworn in at this time. Items were then added to the agenda under the Town Attorney’s report and under New Business. Vice-Mayor Steger presented a plaque and Resolution to John A. Johnston for his many years of service to the Town as a member of Council and as Mayor. Councilman Weddle made a motion to adopt Resolution 2000-17, honoring John A. Johnston, seconded by Councilman Worrell and carried on the following recorded vote: James M. Neblett - Absent Daniel Talbert, Jr. - Aye Lane R. Penn - Aye Joseph L. Weddle - Aye Jeffrey S. Worrell - Aye Pauline G. Mitchell - Aye Bettye H. Steger - Aye Charles W. Stewart, Jr. - Aye Next, Mayor Johnston presented a plaque and a Resolution to Joseph L. Weddle for his service to the Town as a member of Council. Councilwoman Steger made a motion to adopt Resolution 2000-18, honoring Joseph L. Weddle, seconded by Councilman Talbert and carried on the following recorded vote: James M. Neblett - Absent Daniel Talbert, Jr. - Aye Lane R. Penn - Aye Pauline G. Mitchell - Aye Jeffrey S. Worrell - Aye Charles W. Stewart, Jr. - Aye Bettye H. Steger - Aye Next, Councilman Worrell made a motion to adopt the consent agenda consisting of the minutes of June 6, 2000, seconded by Councilwoman Steger and carried on the following recorded vote: James M. Neblett - Absent Daniel Talbert, Jr. - Abstain Lane R. Penn - Aye Joseph L. Weddle - Aye Jeffrey S. Worrell - Aye Pauline G. Mitchell - Aye Bettye H. Steger - Aye Charles W. Stewart, Jr. - Aye Next Councilman Weddle requested that the Finance Director deliver a Finance report. Ms. Boyd advised that all revenue collections are at or above anticipated budgeted levels. She also advised that expenditures to date are under budget. Public Operations Committee Chairman Penn advised that he has been in contact with the Veterans regarding the dedication of the Veterans Memorial Bridge on July 4th and that he expects to have more complete information in a few days. Human Resources Committee Chairman Worrell advised that appointments are needed for the Economic Development Board. He made a motion to re-appoint Wayne Carpenter, Philip Baker, Jack Leahy, Tom Wallace and Joe Weddle for another three year term to the Economic Development Board, seconded by Councilwoman Steger and carried on the following recorded vote: James M. Neblett - Absent Daniel Talbert, Jr. - Aye Lane R. Penn - Aye Joseph L. Weddle - Abstain Jeffrey S. Worrell - Aye Pauline G. Mitchell - Aye Bettye H. Steger - Aye Charles W. Stewart, Jr. - Aye Safety Committee Chairman Worrell advised that he has requested that the Police Department Tactical Team give a demonstration to the Public Safety Committee. Once the details are finalized, he will invite the full Council. Next, Town Attorney Eley recommended that Council consider Ordinance 2000-11, permitting waiver of provisions of deed of trust of Pulaski Furniture, dated 24th day of September 1996. Councilman Stewart made a motion to adopt Ordinance 2000-11, permitting waiver of provisions of deed of trust of Pulaski Furniture, dated 24th day of September, 1996, seconded by Councilwoman Steger and carried on the following recorded vote: James M. Stewart, Jr. - Aye Councilman Penn inquired why Council has to refer requests to Planning Commission rather than the request going directly to Planning Commission? After discussion, Mr. Elander advised that the operative word in state law says that requests shall be “referred” to the Planning Commission. Next, Mr. Elander advised that Ordinance 2000-08 is a redrafted Meals Tax Ordinance. The Ordinance was redrafted to conform with changes made in Virginia legislation during the 1999 and 2000 General assembly sessions. Councilman Weddle inquired whether a public hearing was required prior to adopting this Ordinance? Mr. Elander said his reading of the Charter indicates that a public hearing is not required. The rate of 4% is not being changed. We are conforming our ordinance to state requirements. Councilwoman Mitchell made a motion to adopt Ordinance 2000-08, provisions for tax on meals, seconded by Councilman Weddle and carried on the following recorded vote: James M. Neblett - Absent Daniel Talbert, Jr. - Aye Lane R. Penn - Aye Joseph L. Weddle - Aye Jeffrey S. Worrell - Aye Pauline G. Mitchell - Aye Bettye H. Steger - Aye Charles W. Stewart, Jr. - Aye Next, Mr. Elander advised that the state made changes approximately two years ago to try to make all local business and professional tax license ordinances uniform. When the Town instituted these changes, one section was apparently left out of the ordinance. Ordinance 2000-09 reenacts the omitted section. Councilman Weddle inquired whether a public hearing was required? Mr. Elander advised that it is a technical correction that was inadvertently omitted and does not require a public hearing. After discussion, Councilman Penn made a motion to adopt Ordinance 2000-09, minimum business and professional license tax, seconded by Councilman Worrell and carried on the following recorded vote: James M. Stewart, Jr. - Aye Next, Mr. Elander advised that the Governor has granted July 3rd as an extra holiday for state employees. He recommended to Council that Town employees be granted the same extra holiday for this year only. Councilman Penn made a motion to approve July 3rd as an additional holiday for Town employees for this year only, seconded by Councilman Talbert and carried on voice vote. At 6:45 p.m., there being no further business, meeting adjourned on motion by Councilman Stewart, seconded by Councilman Penn and so carried.
