There were present: Mayor Gary C. Hancock, presiding Council Members: Charles D. Crispin, J. R. Schrader, Jr., Roy H. D'Ardenne, Andrew L. Graham, E. G. Black, Jr., Alma H. Holston, Robert N. Glenn Also Present: Frank Terwilliger, Town Attorney Thomas M. Combiths, Town Manager Robert J. Lyons, Asst. Town Manager Rebekah G. Corso, Acting Clerk Visitors: Paul Dellinger, Roanoke Times Marvin Lester Mary Lee Duncan The meeting was called to order by Mayor Hancock. Councilman Crispin led the Pledge of Allegiance and Councilman Glenn gave the Invocation. Following the roll call, Councilman Black made a motion to appoint Rebekah Corso, Acting Clerk of Council, seconded by Councilman D'Ardenne and so carried. Correction on the minutes of the regular meeting of June 15, 1993, page 3, 1st paragraph, 6th line, should read, "misleading. The utility collections as published are for a 15°s increase". On motion made by Councilman Graham, seconded by Councilwoman Holston and carried, the minutes of the regular meeting of June 15, 1993 were approved as amended, and the minutes of the special meeting of June 29, 1993 were approved as submitted. RESOLU. Mayor Hancock advised the first item on the agenda was the PULASKI consideration of a resolution supporting renovation of the Pulaski THEATRE Theater . 1 Councilwoman Holston made a motion to waive the reading of Resolution No. 93-11, A Resolution Supporting the Renovation of the Pulaski Theater, seconded by Councilman D'Ardenne and so carried. July 6, 1993 9281 Councilwoman Holston made a motion that Resolution No. 93-11 be adopted, seconded by Councilman Black and carried on the following recorded vote: RESOLUTION Charles D. Glenn - Aye Mayor Hancock advised that next on the agenda was a public hearing on a request to close a north/south alley in Block 180 between 4th Street, SE and 5th Street, SE. PUBLICMr. Lyons stated the alley was a 14 foot alley right-of-way between HEAR. 4th Street, SE and 5th Street, SE. There are no plans by the Town to ALLEY open the undeveloped alley right-of-way due to the close proximity of Graham Street and Baskerville Street. A letter was received from an adjacent property owner, Marie Hardy Rogers, which stated she did not object to the proposed closing. Mr. Marvin Lester stated the alley had never developed and the closing would allow the property owners to have two 100 foot lots instead of three 50 foot lots. There being no further comments from the public, at 4:14 p.m. Mayor Hancock closed the public hearing. Councilwoman Holston advised the Public Operations Committee had reviewed the request and would recommend the closing of the alley right-of-way. Councilman J. R. Schrader moved that reading of Ordinance No. 93-17, Closing a Portion of an Undeveloped Alley Right-of-Way between 4th Street, SE and 5th Street, SE in Block 180 in the Town of Pulaski, Virginia be waived, seconded by Councilwoman Holston and so carried. Councilwoman Holston made a motion that Ordinance No. 93-17 be adopted, seconded by Councilman Black and carried on the following recorded vote: ORDINANCE ADO~TED Char es D. Crispin - Aye Andrew L. Glenn - Aye TRAIN WHISTLES From the public, Ms. Mary Lee Duncan addressed Council regarding the issue of trains sounding their whistles between the hours of 11 p.m. and 7 a.m.. Ms. Duncan requested that the Council consider adoption of an ordinance prohibiting the trains from sounding their whistles in the town limits. The matter will be sent to the Ordinance Committee for further review. 9282 July 6, 1993 As there were no further comments from the public, Mayor Hancock called for Council Committee Reports. PERSONNEL COMMITTEE NR Chairman J. R. Schrader advised that his job would require him to Valley resign as the Council's representative on the New River Valley Plan. planning District Committee and would move, on recommendation of the Comm. personnel Committee, that Roy H. D'Ardenne, Jr. be appointed to take his place on the New River Valley Planning District Commission and so carried. FINANCE COMMITTEE WATER Councilman Glenn reported the Finance Committee had met on June 23 RATE and June 28 and discussed 4 items. The Town has received nine proposals for the Water Rate Study. The general consensus among the proposals was that an interim report could be submitted with rate recommendations in approximately 3 months and a final report addressing the next 3-5 years could be submitted in 4 to 6 months. Mr. Lyons advised that interviews were being conducted and a report will be made to Finance Committee upon completion of the interviews. Councilman Glenn reported that staff had met with a representative of the Farmer's Home Administration regarding loan packages currently available. Highlights of those packages are as follows: 5 percent single interest, 40-year term, no closing cost, defer principal payments for two years and no penalty for early payment. Councilman Glenn reported that the Town Engineer and the Public Works Director had prepared a list of water improvements that include annexation projects and priority projects. The water priority projects are still in Committee due the fact that the projects will have to be redefined by priority and the annexation requirements. BOAT Councilman Glenn reported that the Town had expended $152,803 of the PURCHASEtotal of $178,750 General Fund Capital Outlay budget. Councilman Glenn, on recommendation of the Finance Committee, moved that $2,500 SNOW be appropriated from the 92-93 General Fund Capital Outlay for the PLOW purchase of 4 new boats for Gatewood Park and $7,000 be appropriated BLADE for the purchase of a V-Blade attachment for the snow plow for Public Works and so carried on the following recorded vote: Charles D. Glenn - Aye UTILITIES COMMITTEE Chairman Graham had no report. July 6, 1993 PUBLIC OPERATIONS COMMMITTEE Chairwoman Holston reported the Public Operations Committee had met on July 1, 1993 and recommended approval of the alley right-of-way, between 4th Street, SE and 5th Street, SE, closing request. A meeting is being scheduled with several item to be discussed. ORDINANCE COMMITTEE Chairman Glenn had no report. MAYOR'S REPORT Mayor Hancock had no report. TOWN ATTORNEY'S REPORT 9283 UDAG PENN Mr. Terwilliger advised that Mr. George Penn and Mr. Howard Jenkins, Ellery's Blues and More, had approached the Town for a loan of UDAG funds to capitalize changing the night club into a night club/restaurant and to provide some operating capital. At the Town's direction, negotiations were held with the Town Manager, Town Attorney and Mr. Penn to set forth terms and conditions. These terms and conditions have been reviewed by the Council in Executive Session and at this time would request that the Town Council approve a loan to Mr. Penn and Mr. Jenkins on terms and conditions set forth in letter of June 2, 1993. Councilwoman Holston moved to approve a loan of $30,000 in UDAG funds to George Penn and Howard Jenkins, on terms and conditions as outlined in the June 2, 1993 letter, {copy attached to the permanent copy of these minutes} and further moved that Mr. Thomas Combiths, Town Manager and Mr. Frank Terwilliger, Town Attorney, be directed to prepare and execute any necessary documents to carry out those terms and conditions, seconded by Councilman Crispin and so carried on the following recorded vote: Charles D. FEMA Mayor Hancock advised that the Town had received $22,756 in FEMA funds to reimburse the Town for cost incurred during the blizzard and would commend Mike Jenkins for preparation of the application. 9284 July 6, 1993 At 4:35 p.m. Council adjourned on motion made by Councilman D'Ardenne, seconded by Councilman Black and carried.
