There were present: Vice Mayor James R. Neighbors, presiding Council Members: J. R. Schrader, Jr., Mary Lou Copenhaver, Andrew L. Graham, Alma H. Holston, James M. Neblett Also Present: Frank Terwilliger, Town Attorney Don E. Holycross, Town Manager Ruth A. Harrell, Clerk Visitors: Dee Lindsey of the news media Don Crispin Mildred Bolen The invocation was given by Councilwoman Holston. Vice Mayor Neighbors stated the purpose of the special meeting was to adopt the 1990-1991 Town of Pulaski Budget. Councilman Neblett so moved that the reading of Resolution Approving the Budget for the Town of Pulaski, Virginia, for the fiscal year beginning July 1, 1990 and ending June 30, 1991, Ordinance setting the 1990 rate of Taxation on Real Estate and Personal Property, Ordinance setting for the charges for water service for service on or after July 1, 1990, Ordinance Setting Forth the Sewer Service Charges for Service on or after July 1, 1990, Ordinance Chapter 16, Article V, Section 16-84, Amending the Pulaski Town Code to Establish New Rates to be levied under the consumer utility tax, and A resolution establishing Appropriations for the Town of Pulaski, Virginia, for the Fiscal Year Beginning July 1, 1990 and Ending June 30, 1991, be waived, seconded Councilwoman Holston and carried. Councilman Neblett so moved that A Resolution approving the budget for the Town of Pulaski for the fiscal year beginning July 1, 1990 and ending June 30, 1991, second ed by Councilwoman Holston and carried on the following recorded vote: 1990-91 BUDGET James M. Glenn - Absent A Resolution Approving the Budget For the Town for Pulaski, Virginia for the Fiscal Year beginning July 1, 1990 and Ending June 30, 1991 WHEREAS, the Towr. Manager of the Town of Pulaski, Virginia, did present to the Finance Committee of the Town Council of the Town of ^ June 28, 1990 8757 Pulaski a proposed budget for the fiscal year beginning July 1, 1990 and ending June 30, 1991; and, WHEREAS, said Finance Committee, together with other members of the Town Council, did meet and review and revise said proposed budget, and did finalize a proposed budget for said fiscal year to be used for informational and planning purposes only, pursuant to Section 15.1-160, et seq., of the 1950 Code of Virginia, as amended; and, WHEREAS, a brief synopsis of said budget was proposed by the Finance Committee was published as prescribed by law, together with a notice of hearing to be held on June 19, 1990, by the Town Council at regular meeting; and WHEREAS, a public hearing on said proposed budget was held on June 19, 1990, by the Town Council in regular session; and, WHEREAS, as a result of said hearing, the Town Council has finalized and refined said budget; NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Pulaski, Virginia, that said proposed budget, as revised, BE AND HEREBY IS APPROVED as the budget for the Town of Pulaski, Virginia, for the fiscal year beginning July 1, 1990 and ending June 30, 1991, in accordance with Section 15.1-160, et. seq. of the 1950 Code of Virginia as amended. PROVIDED, HOWEVER, that as in accordance with said Code, this budget is for informative and fiscal planning purposes only, and in no event shall this approval be deemed an appropriation. Moreover, no money shall be paid out for any contemplated expenditure unless and until there has first duly been made an annual, semiannual, quarterly or monthly appropriation for such contemplated expenditure by this Town Council. This RESOLUTION is effective upon adoption, and is ADOPTED this 28th day of June 1990. Glenn - Absent ORDINANCE Setting the 1990 rate of Taxation on Real Estate and Personal Property WHEREAS, the Town Council of the Town of Pulaski, Virginia, has the duty to fix the tax rates on all real and personal property properly subject to taxation within and by the Town, and must assess such taxes as may be required to provide for the needs and purposes of the Town; NOW, THEREFORE, be it ORDAINED BY THE Town Council of the Town of . Pulaski, that the 1990 tax rate on all real property properly subject to g7~8 June 28, 1990 taxation within and by the Town shall be thirty-four cents ($.34) per one hundred dollars ($100.00) of assessed value and that the 1990 tax rate on all personal property properly subject to taxation within and by the town shall be seventy-four (5.74) per one hundred dollars of assessed value. These rates will continue until changed by Ordinance. This ordinance is adopted this 28th day of June, 1990, to be effective the 1st day of July, 1990, by recorded vote of the Town Council. Councilman Neblett so moved that Ordinance setting forth the charges for Water Service for Service on or after July 1, 1990, be adopted, seconded by Councilwoman Holston and carried on the following recorded vote: ORDINANCE ADOPTED James M. Glenn - Absent ORDINANCE Setting Forth the Charges for Water Service for Service on or after July 1, 1990 BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in special session on June 28, 1990, that the rates to be charged for water service shall be and hereby are, amended to read as follows: Charges for water service generally. a. Consumers other than those subject to the provisions of section 29-15 within the corporate limits of the Town shall pay for water purchased from the Town at the following rate: First 3,000 gallons minimum $6.38 Next 20,000 gallons .99 per 1000 gallons Next 200,000 gallons .90 per 1000 gallons Next 777,000 gallons .83 per 1000 gallons Next 1,000,000 gallons .73 per 1000 gallons b. Consumers in the same category as subsection (a) above, but who are outside the corporate limits, who purchase water directly from the Town shall pay for the water at the following rate: First 3,000 gallons Next 20,000 gallons Next 200,000 gallons Next 777,000 gallons Next 1,000,000 gallons c. Consumers with one meter and mobile homes in a park, $12.76 1.98 per 1.80 per 1.66 per 1.46 per for multi-family housing commercial and business b 1000 gallons 1000 gallons 1000 gallons 1000 gallons units, trailers uildings: I. In-Town Minimum rate (for first 3,000 gallons): $6.38 for first unit; $3.63 for each unit thereafter. II. Outside Town ^ June 28, 1990 8759 Rates shall be double the In-Town rates. 0 The foregoing rates are effective as of July 1, 1990, and will apply to water furnished on or after that date. It will not apply to water furnished prior to said date, even though it may be billed after said date. All other fees relating to water service shall remain in full force and effect. Glenn - Absent Ordinance Setting Forth the Sewer Service Charges for Service on or after July 1, 1990 BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in special session on June 28, 1990, that the rates to be charged for monthly sewer service shall be as follows: Sewer Service Charge. ~] a. The Town customers for water and sewer service who live within the corporate limits of the Town, as they exist now or may hereafter be changed, shall pay for sewer services at the following rates, which shall be applied to the amount of water purchased: First 3,000 gallons minimum Next 20,000 gallons Next 200,000 gallons Next 777,000 gallons Next 1,000,000 gallons $ 15.12 2.34 per 1000 gallons 2.16 per 1000 gallons 1.92 per 1000 gallons 1.74 per 1000 gallons b. Such customers who live outside the corporate limits of the Town, as the same exist or may hereafter be changed, shall pay for sewer service at the following rates, to be applied to water purchased: First 3,000 gallons minimum $30.24 Next 20,000 gallons 4.68 Next 200,000 gallons 4.32 Next 777,000 gallons 3.84 Next 1,000,000 gallons 3.48 c. Consumers with one meter for multi-family housi and mobile homes in a part, commercial and business I. In-Town per 1000 gallons per 1000 gallons per 1000 gallons per 1000 gallons ng units, trailers buildings: Minimum rates (for first 3,000 gallons); $15.12 for first unit; 8760 June 28, 1990 58.64 for each unit thereafter. II. Outside Town Rates shall be double the In-Town rates. d. For those customers, whether within or without the Town, who discharge water not purchased from the Town, using Town sewer service, the foregoing rates shall be applied to the amount discharged into the sewer system, to be determined either by meters or by estimates according to general engineering principles. The foregoing rates are effective as of July 1, 1990, and will apply to services furnished on or after said date. It will not apply t services furnished prior to said date, even though not billed until after said date. A11 fees relating to sewer service shall remain in full force and effect. This ordinance is effective as of July 1, 1990. Glenn - Absent ORDINANCE Chapter 16, Article V, Section 16-84 Amending the Pulaski Town Code to Establish New Rates to be Levied Under The Consumer Utility Tax BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in special session on June 28, 1990, that Chapter 16, Article V, Section 16-84 of the Pulaski Town Code be, and the same hereby is, amended to establish new rates to be levied under the consumer utility tax: Chapter 26 Article V. Consumer Utility Tax Section 16-84. Imposition, rates. There is hereby imposed and levied by the town upon each purchaser of a utility service a tax in the amount of fifteen (15) percent of the charge, exclusive of any federal tax thereon, subject to the limitations set out in this article, made by the seller against the purchaser with respect to each utility service. Such tax in every case shall be collected by the seller from the purchaser and shall be paid by the purchaser unto the seller for the use of the town at the time the purchase price or such charge shall become due and payable under the June 28, 1996 87i~1 agreement between the purchaser and the seller, provided that in case any monthly bills submitted by any seller for residential electric, gas or telephone utility service shall exceed fifteen dollars (515.00) for a residential user, there shall be no tax computed on so much of such bill as shall exceed fifteen dollars (515.00). In case any monthly bill is submitted by any seller for a commercial or industrial user of electric, gas or telephone utility service shall exceed two hundred fifty dollars (5250.00), there shall be no tax computed on so much of such bill as shall exceed two hundred fifty dollars (5250.) In case a bill is submitted by the seller for the purchase made by the user during periods of greater than one (1) month, then the amount of such bill subject to taxation shall be the amount in which a bill for the subject utility would be taxed in a single month multiplied by the number of months for which such bill is submitted." This ordinance shall become effective on the 1st day of July, 1990, and shall apply to utilities billed on and after the 1st day of September, 1990. This ordinance is adopted this 28th day of June, 1990. APPROP, for the Town of Pulaski, Virginia, for the Fiscal Year Beginning July 1, 1990 and Ending June 30, 1991 WHEREAS, the Town Manager of the Town of Pulaski, Virginia did present to the Finance Committee of the Town Council of the Town of Pulaski a proposed budget for the fiscal year beginning July 1, 1990 and ending June 30, 1991; and, WHEREAS, said Finance Committee, together with other members of the did finalize a proposed budget for said fisca year to be used for informational and planning purposes only, pursuant to Section 15.1-160, et seq., of the 1950 Code of Virginia as amended; and, WHEREAS, the Town Council has approved the budget for the fiscal year beginning July 1, 1990 and ending June 30, 1991; and WHEREAS, it is now necessary to adopt appropriations for purpose of implementing said budget. Councilman Graham advised that he had received inquiries of increase in rates of cable t.v. and requested this topic be added to agenda. Councilwoman Copenhaver so moved that this item be added to agenda, seconded by Councilwoman Holston and so carried. 8763 CABLE TV Councilman Graham so moved that the Town Attorney prepare a resolution to be forwarded to our representatives supporting Congress in a bill to control prices for basic cable TV services and ensure competition. Motion seconded by Councilman J. R. Schrader and carried. At 4:08 p.m., Councilman Neblett made a motion that Council adjourn, seconded by Councilwoman Holston and carried.
