Minutes of the special meeting of the Pulaski Town Council held
December 21, 1990, at 8:00 a.m. in the Council Chambers in the Municipal
Building.
There were present: Mayor Gary C. Hancock

The Invocation was given by Mayor Hancock.
Mayor Hancock advised the purpose of meeting was a personnel matter
and consideration of resolution amending the sick leave policy.
Chairwoman Copenhaver read the following statement: "The Personnel
Committee, other members of Council, and the Town Manager have completed
a series of interviews with the four applicants from the Pulaski Fire
Department who applied for the Fire Chief's position to replace the
retiring Bill Hall. Each of the candidates was interviewed extensively
on at least three separate occasions. In addition, three other members
of the department and one person in the emergency services field outside
of the Pulaski Fire Department were asked to evaluate the four
candidates.
It has been a difficult decision to make. All four candidates are
valuable members of the Fire Department, have been well-prepared for a
leadership position within the department, and were impressive during
the selection process.
HENSEL J. HALI~owever, I am pleased to announce that the Personnel Committee and
APPT. the Town Manager are recommending to the Town Council that Jeff Hall be
FIRE a ointed as the new Pulaski Fire Chief. Jeff was first appointed to
CHIEF the Fire Department in July 1974; was re-appointed in August, 1977; was
promoted to Lieutenant in November, 1982; and was promoted to Captain in
October, 1984. As Captain, Jeff has been responsible for supervising
his shift and for supervising emergency scenes in the absence of the

Fire Chief.
Jeff is married and the father of two daughters. Jeff, by the way,
is unrelated to Chief Bill Hall."
Chairwoman Copenhaver made a motion that Jeff (Hensel J.) Hall be
appointed as Pulaski Fire Chief, seconded by Councilman Glenn and
carried on the following recorded vote:

Jeff expressed appreciation to Council, Town Manager, Chief Hall,
Eire Department and his family.
Council then reviewed a Resolution amending the sick leave policy.
Mr. Holycross proceeded to read the changes to the policy. This
amendment provides that a permanent, full-time employee with at least
one year of service with the Town who has exhausted all sick leave,
compensatory leave and annual leave, may make application to the Town
Manager for extended sick leave.
After discussion by Council, Councilwoman Copenhaver so moved that
Resolution be adopted, seconded by Councilwoman Holston and carried on
the fallowing recorded vote:

RESOLUTION
BE IT RESOLVED that the Town Council hereby amends Section 11.11
of the Personnel Policies and Procedures Manual to read as follows:
"11.11 PROCEDURES FOR MEDICALLY - RELATED ABSENCES
(1) Absences for two (2) or less consecutive work days.
(a) For the first two (2) such absences within a 6 month
period:
1) The employee must notify the employee's immediate
supervisor at least thirty (30) minutes prior to the
start of the shift for which the employee is scheduled
to work, on each day that the employee is scheduled
to work, of the fact that the employee will be absent,
the reason for such absence, and the probable length
of such absence.
2) A doctor's certificate may be required, at the option
of the Town.

{b) For the third or subsequent absence within a 6 month
period, a doctor's certificate is necessary stating the
illness or temporary disability from which the employee
is suffering and that said illness or disability, in the
opinion of the treating physician, rendered the employee
unable to perform his normal duties. The certificate
shall be furnished to the employee's immediate supervisor
no later than the start of the shift for which the
employee is scheduled to work on the day that the employee
returns to work.
(2) Absences for three (3) or more consecutive work days.
(a) Unless hospitalized, a doctor's certificate shall be
furnished to the employee's immediate supervisor no later
than the start of the shift on the third day for which
the employee is scheduled to work, stating:
1) The nature of the employee's condition;
2) The expected date on which the employee will return
and perform normal work duties; and,
3) A statement as to whether the employee's medical
disability is or is not chronic in nature.

~3,~ Medical absences by the employee shall be charged to the
employee in the following order:
~a L Accumulated sick leave;
,~ Accumulated compensatorv time;
,~ Accumulated annual leave.
~_ A permanent full-time employee with at least one year of
continuous service with t_he Town, who has exhausted all sick
leave com ensator time and annual leave ma make
application to the Town Manaaer for extended sick leave In
reviewing the application the Town Manaaer shall consider
the following:
u_ The nature of the employee's condition;
LL The ex ected date an which the em to ee will return
and perform normal work duties;
~cZ Whether the employee's medical disability is chronic in
nature• and,
~_ The impact of the employee's continued absence on the
department to which the employee is assigned and the
impact on public health and safety.
In addition to the above considerations, the Town Manager shall
have the right to deny the application for extended sick leave
where:
~_ The iob responsibilities of the employee are such that
to grant the extended leave would have a significant
adverse effect on the daily operations of the department
to which the employee is assianed• or,
~b,l_ The employee's iob responsibilities are directly related
to public health or safety and extended leave would
have an adverse effect on public health and safety• or,
Lc,~, There are no readily available personnel to assume the_
employee's duties on a temporary basis during the
extended leave.
The Town Manaaer may grant extended sick Leave not to exceed 45
work days. An employee who received extended sick leave shall,
upon returning to work have the amount of such extended leave
deducted from accrued sick leave, compensatorv time, and annual
leave until the balance of extended sick leave is reduced to zero.

Extended sick leave may be granted more than once for an employee
but subsequent arants must be for a different, unrelated illness.
In no case, however, may the cumulative balance of extended sick
leave exceed 45 work days.
~. When a doctor's certificate states that the employee is
expected to be unable to perform the employee's normal duties,
either (1) longer than the total of the employee's accumulated
sick leave, compensatory leave, and annual leave, or (2) for
a period of 30 days or longer, whichever of (1) or (2) is
shorter, then:
The employee shall submit to a physical examination of a
qualified physician of the Town's choosing, at the Town's
expense, unless the employee is hospitalized or the
employee's physician certifies that such medical
examination would be injurious to the employee's health;
or, where the cause of the disability is obvious, such as
in cases of pregnancy or broken limbs.
b1 Where it appears from the report of either employee's
physician or the Town's physician that:
L1 ,L The employee would be unavailable to perform all
regular job duties for a period of four (4) months
or longer, and the employee is ineligible for a
leave of absence; or,
~_ The employee suffers from a problem which is chronic
in nature, so that there is a reasonable expectation
that the employee shall be unable to perform his
normal job duties for a period of 60 days or more
during the next calendar year; then,
The Town will have just cause for terminating said employee
and shall terminate said employee
,~ Where a physician's certificate indicates that an
employee is eligible to return to work subject to
limitations or restrictions on the type of duties that
can be carried out by the employee, then the Town shall
have the option of offering such work, either for the
full period of recovery, or as much thereof as is
necessary to carry out the Town's business. There will be
no obligation on the Town to provide such work; however,
in the event that the Town does offer such work to the
employee and the employee fails to accept such work, the
Town shall be deemed to have just cause for terminating
said employee and shall terminate said employee."

This RESOLUTION is effective upon adoption, and is ADOPTED this
21st day of December, 1990, by recorded vote of the Town Council of the
Town of Pulaski, Virginia, as follows:
WAIVER OF NOTICE OF SPECIAL MEETING
We, the undersigned, duly elected members of the Council of the
Town of Pulaski, Virginia, hereby waive notice of a Special Meeting of
said Council at 8:00 a.m. on the 21st day of December, 1990, for the
purpose of a personnel matter.
