There were present: Mayor Gary C. Hancock, presiding 8899 Council Members: Charles D. Crispin, J. R. Schrader, Jr., Mary Lou Copenhaver, James R. Neighbors, Andrew L. Graham, W. H. Schrader, Jr., Alma H. Holston, Robert N. Glenn Also Present: Frank Terwilliger, Town Attorney Don E. Holycross, Town Manager Robert J. Lyons, Asst. to the Town Manager Ruth A. Groseclose Henderson Randolph The Pledge of Allegiance was led by Councilman J. R. Schrader. The Invocation was given by Councilwoman Holston. After roll call and welcome by Mayor Hancock, Councilwoman Holston so moved that minutes of the regular meeting of February 19, 1991, be approved as recorded, seconded by Councilman Crispin, and carried. STREET Mr. Alan Groseclose, representing W. D. Development, addressed VACCouncil regarding the out parcel of land in area of shopping center on Memorial Drive which they have acquired. They wish to get their front property line straightened as there is an irregular right of way along Memorial Drive. In 1973, this land laid out in a subdivision by C. W. Barker and was never approved except portion approved next to Windsor Ave. The highway department acquired right of way for Memorial Drive and cross street ran through this location. There is a curb cut which could be used as entrance to out parcel. They are requesting that the Town Council take the necessary action to vacate this indentation so as to have a straight boundary line along Memorial Drive. The old Barker plat was presented for file. Councilman J. R. Schrader made a motion that this request be referred to the Public Operations Committee for their review, and that a public hearing be scheduled, seconded by Councilman Neighbors and carried. Mr. Groseclose also requested that the old general easement be released and in turn, that the Town accept the water and sewer lines as they are in the ground on site of shopping center on Memorial Drive. 8900 March 5, 1991 Mayor Hancock suggested this matter be considered at the meeting that public hearing will be held. Mr. Terwilliger reported that Town Council had already authorized the Town Manager to execute an agreement fixing location of the easements. The issue that remains is whether the Town wants to accept the sewer lines and water lines that have been put on property into the Town's system for future maintenance and ownership by the Town. Mr. Henderson Randolph was brought up to date on the operation of the traffic light on Washington and Main Street. Mr. Henderson also questioned if patrol cars should not go to corporate limits. Mrs. Polly Mitchell questioned the sign at Washington and 6th Street stating "Historic District" as she felt it should be removed. The Town has not adopted historic district zoning for this area, however, it is a historic district as designated by the state and by the federal government. Dr. Winsdon N. Pound, Chairman, Pulaski County Alcohol and Drug Abuse Task Force, Inc., Local CADRE, addressed Council and suggested a hero's welcome when our troops return from the Persian Gulf. Mayor Hancock stated that Town Council would be glad to participate in celebration. Dr. Pound distributed literature and gave report on work being done on alcohol and drug abuse, and especially the assistance being given to our young people. Appreciation was expressed to Dr. Pound for the fine job he is doing. Dr. Pound further offered suggestions whereby the Town could assist in their programs, and asked that we first become involved in their meetings. Mayor Hancock then called for Council Committee Reports. PUBLIC & PERSONNEL RELATIONS, NOMINATING COMMITTEE Chairwoman Copenhaver stated that the Personnel Committee had met March 5 at 3:15 p.m. in Executive Session. FINANCE COMMITTEE Chairman Neighbors had no report. UTILITIES COMMITTEE Chairman Graham had no report, however, he did request an Executive Session on a legal matter. ORDINANCE COMMITTEE Chairman W. H. Schrader had no report. PUBLIC OPERATIONS COMMITTEE Co-Chairwoman Holston and Co-Chairman J. R. Schrader had no report. March 5, 1991 8901 MAYOR'S REPORT Mayor Hancock suggested that a letter be sent to Jim Delehanty from the Council thanking him for the services he has rendered to the Town and entire County. He has sponsored several events in aid of the train station, restoration of court house, and organized the rally we had in Jackson Park for our troops in the Persian Gulf. Mr. Delehanty is now working in Blacksburg. TOWN ATTORNEY'S REPORT Mr. Terwilliger had no report. TOWN MANAGER'S REPORT Mr. Lyons reported that the Town will be submitting an application for $340,000 for improvements in the Cool Springs Area. Sanitary sewer service will be extended, drainage improvements made, street paving and street lighting installed. A resolution authorizing the Town Manager to submit the application was presented. Councilman Glenn so moved that reading of the Resolution be waived, seconded by Vice Mayor Neighbors, and carried. Councilwoman Holston made a motion that Resolution be adopted, seconded by Councilwoman Copenhaver and carried on the following recorded vote: RESOLUTION - GRANT ADOPTED Charles D. Glenn - Aye RESOLUTION N0. 91-3 BE IT RESOLVED that pursuant to public hearings, the Town of Pulaski wishes to apply for $370,340 of Virginia Community Development Block Grant funds for the Cool Springs Neighborhood Improvements Project. WHEREAS, it is projected that 82 persons (70 low and moderate income (LMI) persons) will benefit from the extension of sanitary sewer service, 7 persons (7 LMI persons) will benefit from bathroom additions, 55 persons (48 LMI persons) will benefit from drainage and street paving and 148 persons (121 LMI persons) will benefit from the addition of street lighting; and WHEREAS, the Town of Pulaski agrees to fund $31,760 as the Town's contribution to the project cost. The Town's funding share includes general fund and sewer fund revenues and direct project costs incurred by the Town, including architectural, engineering, inspection and legal fees; and WHEREAS, the Town Council hereby agrees to comply with all necessary rules, regulations and assurances in conjunction with the grant; 8902 March S, 1991 BE IT FURTHER RESOLVED that the Town Manager is hereby authorized to sign and submit the appropriate documents for submittal of this Virginia Community Block Grant Application. THIS RESOLUTION is adopted this 5th day of March, 1991 by recorded vote of the Town Council of the Town of Pulaski, Virginia. ORDINANCE CLOSING Ordinance No. 91-6 closing an undeveloped alley in Blocks 172 and ALLEY 173 of the Town was next considered. A public hearing on this closing was held at the last Council meeting. Councilwoman Holston so moved that reading of the ordinance be waived, seconded by Councilman W. H. Schrader and carried. Councilwoman Holston so moved that Ordinance No. 91-6 be adopted, seconded by Vice Mayor Neighbors and carried on the following recorded vote: Charles D. Crispin - Aye Andrew L. Graham - Aye J. R. Glenn - Aye ORDINANCE CLOSING RN UNDEVELOPED ALLEY IN BLOCKS 172 and 173 OF THE TOWN WHEREAS, as shown on the 1908 Map of Pulaski, Virginia, prepared by C. E. Derrick, D.E., and recorded in the Office of the Clerk of the Circuit Court of Pulaski County, Blocks 172 and 173 of the Town were subject to a twenty foot alley running from Fifth Street S.E. across the platted Fourth Street to Stuart Avenue, parallel to Graham Street; and, WHEREAS, by Deed of Exchange dated October 18, 1955, recorded in Deed Book 170 at page 58, the Town of Pulaski vacated that portion of said alley which crossed Lot 3 of the C.N. Tester Subdivision in Block 172, but was granted an easement across the resubdivided Lot 3, as shown on a plat recorded in Plat Book 2 at page 179; and, WHEREAS, neither the original platted alley nor the relocated portion accepted as an easement have ever been developed or put into use by the Town; and, the adjoining landowners have petitioned the Town to vacate and close said alley and easement; and, WHEREAS, after public notice and a public hearing as required by law, the Town Council finds that it is in the best interest of the Town and its citizens to close and vacate said alley and easement; NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on March 5, 1991, that the twenty foot alley running from Fifth Street S.E. Across the platted Fourth Street to Stuart Avenue, parallel to Graham Street, as shown on the plat map attached hereto and made a part hereof, be and hereby is vacated, closed and abandoned by the Town. The Town hereby quitclaims any interest in the portion of the alley running from Stuart Avenue through Block 173 and into Block 172 to the North side of Lot 3 in Block 172, from its centerline to the respective March 5, 1991 8903 abutting lot owners on either side, it being the Town's intention, insofar as it may do so, to quitclaim each such lotowner on either side, only that section of the alley necessary to extend each such lot to the center of the alley. This quitclaim is made without warranty of any kind as to the interest conveyed or as to the identity of any lotowner. The Town further quitclaims without warranty, to the present owner of Lot 3, Block 172, any interest in that easement or right of way reserved in Deed Book 170 at page 58, or in the alley itself, insofar as it has the power to do so. There are excluded from this abandonment and quitclaim, and reserved by the Town, any and all utility easements that may exist in favor of the town, its successors or assigns. This Ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia on this 5th day of March, 1991. LANDFILL/W the ~r. Holycross brought Council up to date on the proposed Wythe County landfill. At a meeting held in Wytheville, Mr. Holycross expressed concern over proposed site 39 as it was felt it would drain into Peak Creek. Also under consideration is site 40 adjacent to site 39 but it does not pose as much of a threat to the Town because the surface water from this site drains in the opposite direction. It appears that the four jurisdictions (Wythe County, Bland County, Town of Wytheville, and Town of Rural Retreat) favor site 40 and engineer has been authorized to go ahead and establish some benchmarks on the site so the engineers can also proceed with additional detailed drilling and site analysis. Mr. Holycross will continue to closely monitor the proposed landfill. INSURANCE Mr. Holycross reported that renewal rates for Blue Cross/Blue Shield had been received from the State program. Program will only increase by 2.2% for 1991-1992 and will be effective July 1, 1991 through June 30, 1992. Cep Mr. Holycross reported that the equipment associated with our 9-1-1 system has been installed and we are now testing the system. We are hopeful that the 9-1-1 systems for both the County and Town will be fully operational sometime during the first part of April. Mr. Holycross requested an Executive Session on a legal matter and a personnel matter under 2.1-344, Al and A7. Councilman Crispin so moved that Council go into Executive Session on two legal matters A7 and one personnel matter A1, seconded by Vice Mayor Neighbors and carried on the following recorded vote: Charles D. Glenn - Aye At 4:56 p.m. Council went into Executive Session. At 6:00 p.m. Council returned to regular session and waived reading of the certification resolution on motion made by Vice Mayor Neighbors, 8904 March 5, 1991 seconded by Councilman W. H. Schrader and carried. Vice Mayor Neighbors made a motion that certification resolution be adopted, seconded by Councilwoman Holston and carried on the following recorded vote: Charles D. Hancock - Aye CERTIFICATION RE5OLiJTION ADOPTED CERTIFICATION RESOLUTION PULASKI TOWN COUNCIL WHEREAS, the Pulaski Town Council has convened an executive meeting on this date pursuant to an affirmation recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and, WHEREAS, 52.1-344.1 of the Code of Virginia requires a certification by this Pulaski Town Council that such executive meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Pulaski Town Council hereby certifies that, to the best of each member's knowledge, (ij only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Pulaski Town Council.
