There were present: Mayor Gary C. Hancock, presiding Council Members: Charles D. Crispin, Mary Lou Copenhaver, James R. Neighbors, Andrew L. Graham, Alma H. Holston, Robert N. The Invocation was given by Councilman Robert N. Glenn. After the roll call, Councilwoman Holston so moved that the minutes of the regular meeting of April 16, 1991, be approved as submitted, seconded by Councilman Glenn and carried. STUDENT GOV.Mayor Hancock welcomed visitors and advised it had been a very DAY special day as we had students from Pulaski Middle School participating in Student Government Day. He introduced the students as follows: Mayor - Lee Eure, Town Manager - Lindsay Huff, Town Council Members - Jill Williams, Kim Smith, Georgianna Aust, Chanda Tracy, Treasurer - Nikki Rupe, Engineer - Garnett Thompson, Fire Chief - Jennifer Hill, Chief of 5934 May 7, 1991 Police - Matt Gardner, Director of Recreation - Jeanni Hagee, and Director of Public Works - Cindy Hooper. The students had visited with the various departments and had held a mock Council meeting earlier in the day. MAIN STREET Mr. Doug Phelps gave a presentation on the Main Street Program and advised what had been accomplished during the past three years. An interesting slide program was also presented illustrating the improvements made in structures on Main Street. Statistical information regarding the program as well as letters of support have been attached to the permanent file copy of minutes of this meeting. As there were no further comments from the public, Mayor Hancock E called for Council Committee reports. PUBLIC & PERSONNEL RELATIONS, NOMINATING COMMITTEE BEAUTIFICATION Chairperson Copenhaver so moved that Mary Frances Williams be appointed to the Beautification Committee for a three year term, seconded by Vice Mayor Neighbors and carried. Chairperson Copenhaver also advised that it was planned that a Dogwood be planted in memory of Vickie Hawks, a deceased member of the Beautification Committee. FINANCE COMMITTEE The Finance Committee will meet Friday, May 17, at 7:30 a.m. to start their review of the budget. UTILITIES COMMITTEE WATER 'TANK Chairman Graham requested an update on the water tank contract with Mr. Holycross reporting that we received approval from the state for the design changes and we are still negotiating with the tank manufacturer an adjustment to the price that they had submitted. This should be finalized very quickly. Chairman Graham also requested a legal item be discussed in Executive Session. ORDINANCE COMMITTEE Chairman W. H. Schrader absent. PUBLIC OPERATIONS COMMITTEE Co-Chairwoman Holston had no report but advised the committee would meet Wednesday, May 15 at 4:00 p.m. TOWN ATTORNEY'S REPORT Mr. Terwilliger had no report. TOWN MANAGER'S REPORT Mr. Holycross stated that before Council was Ordinance No. 91-9 to rezone 6.6 acres of land along Route 11 near the southern intersection with Pleasant Hill Drive. A public hearing on this request was held at the last Council meeting. May 7, 1991 8935 Councilwoman Holston so moved that reading of the ordinance be waived, seconded by Vice Mayor Neighbors and carried. Councilwoman Holston made a motion that ordinance No. 91-9 be adopted, seconded by Vice Mayor Neighbors and carried on the following recorded vote: Charles D. Crispin - Aye Andrew L. Graham - Aye J. Glenn - Aye ORDINANCE ORDINANCE N0. 91-9 REZONING TOWN OF PULASKI, VIRGINIA Ordinance Rezoning 6.6 Acres of land, Known as Tax I.D. #063-025-0000-028, Along Route 11 Near the Southern Intersection with Pleasant Hill Drive WHEREAS, after notice as required by law, the Town Council and the Town Planning Commission held a public hearing on April 16, 1991 on the possible rezoning of certain acreage owned by Mrs. Evelyn Hall English along Route 11 (Lee Highway) near the southern intersection with Pleasant Hill Drive; and, WHEREAS, following the public hearing, the Planning Commission formally recommended to the Town Council that the parcel of land referred to as Tax I.D. #063-025-0000-028, containing 6.6 acres of land, be rezoned from R-2, Residential to R-R, Rural Residential, and, WHEREAS, in conjunction with the recommended rezoning, the Planning Commission also requested that a no U-turn sign be erected on Route 11 at Memorial Drive for traffic traveling north on Route 11, and, WHEREAS, after due consideration of the information before it as evaluated by appropriate zoning standards, the Town Council finds that the rezoning classification recommended by the Planning Commission is reasonable and suitable for the property in question. NOW, THEREFORE, BE IT ORDAINED by the COUNCIL of the TOWN OF PULASKI, VIRGINIA, sitting in regular session on May 7, 1991, that: Section 1. The property listed as Tax I.D. #063-025-0000-028 containing 6.6 acres of land along Route 11 near the southern intersection with Pleasant Hill Drive, be, and the same hereby is, rezoned from R-2, Residential, to R-R, Rural Residential. Section 2. The Town Zoning Administrator is directed to mark this change and the effective date on the Master Zoning Map for the Town of Pulaski and said map is hereby amended to incorporate this change Section 3. This ordinance is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 7th day of May, 1991. Mr. Holycross reported that in September, 1989, the Acting Town Manager at that time executed a renewal of a lease agreement with the $936 May 7, 1991 TOWN PROPERTY Vance Company, Inc. wherein the Vance Company continued to lease from the Town a small building located adjacent to the Fire Department parking lot. The terms of the agreement stipulated that the Vance Company would pay $50.00 per month for the lease; that the lease period would extend until August 15, 1991, and that the Vance Company could assign the lease to D. W. Ratcliff. Mr. Ratcliff passed away in February of this year and his son who is serving as the Executor of the estate has requested that the town release the estate from the lease obligation effective April 15, 1991. The Vance Company has concurred with this request. Because the building is adjacent to the Fire Department, Chief would like to assume control over the building and would like to use as an office for the Fire Prevention Officer. He would then convert existing Fire Prevention Officer's office into an office for the Captains. Hall it the Councilman Crispin so moved that the Town Manager be authorized to execute a cancellation of the lease agreement with the Vance Company/D. W. Glenn - Aye Mr. Holycross stated there Honoring the Community Yard Sal Students, Honoring Neighborhood Claremont Chargers Chess Team. reading of these resolutions be and. carried. were four Resolutions before Council; e, Honoring Virginia Dance Company Crime Watch Coordinators and Honoring Councilwoman Copenhaver so moved that waived, seconded by Councilman Crispin Councilman Crispin made a motion that these four Resolutions be adopted, seconded by Councilwoman Holston and carried on the following recorded vote: RESOLUTIONS ADOPTED Charles D. Glenn No. 91-13 RESOLUTION HONORING COMMUNITY YARD SALE Aye Absent Aye Aye WHEREAS, the Community Yard Sale, held April 11-13, raised a total of over $4,700, which was divided equally among the Emergency Needs Task Force, Habitat for Humanity and the Pulaski County Free Clinic; and WHEREAS, under the coordination of Anna and Tom Powers, the event exceeded its goal by $3,000; and WHEREAS, the coordinators of the Community Yard Sale received support from the community, area churches, organizations and volunteers. May 7, 1991 $937 NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on May 7, 1991, that the Town Council should and hereby commends the efforts of the Powers and all the Community Yard Sale's volunteers which benefitted the Emergency Needs Task Force, Habitat for Humanity and Pulaski County Free Clinic. This resolution is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 7th day of May, 1991. No. 91-14 RESOLUTION HONORING VIRGINIA DANCE COMPANY STUDENTS WHEREAS, the dance students of Elizabeth Ayers of the Virginia Dance Company traveled to Hickory, North Carolina to compete in Showstopper's, the largest dance competition in the he world, with more than 80,000 participants; and WHEREAS, Kerri Weddle, Karen Spraker and Allison Phillippi received a first place award in the 15-year old ballet category for their classical performance of Don Quixote. Erin Yoder, Laura McGlothlin, Rebekkah Warburton, Sara Woodie and Laruen Huff received a second place award for their performance of Little Swans from Swan Lake; and WHEREAS, both groups will travel to Myrtle Beach to compete for the WHEREAS, Josie McMillan, Emily Folsom, Karen Spraker and Kerri Weddle came in 5th place for their jazz piece, Dangerous. NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on May 7, 1991, that the Town Council should and hereby honors the Pulaski students for their excellence in the Showstoppers regional dance competition. This resolution is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 7th day of May, 1991. No. 91-15 RESOLUTION HONORING NEIGHBORHOOD CRIME WATCH COORDINATORS WHEREAS, the Neighborhood Crime Watch Program is a national crime prevention program that involves citizens in the safety and security of their neighborhoods; and WHEREAS, the Crime Watch Program includes an active awareness of suspicious activity, the posting of warning signs, home security inspections and Operation ID; and WHEREAS, the Town of Pulaski has twelve Neighborhood Crime Watch programs. The Crime Watch Coordinators are Bettye Steger, Patsy Gilbert, Dewey Epperly, Helen Farmer, James Hyatt, Donna Colley, Ethel Lewellyn, Colleen East, Pat Lindamood, Allen Powers, Beverly Hudson and Richard Repass. The Area Coordinators are assisted by 58 Block 8938 May 7, 1991 Captains. NOW, THEREFORE, be it Resolved by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on May 7, 1991, that the Town Council should and hereby commends the Neighborhood Crime Watch Program and the dedication of the Area Coordinators and Block Captains. This Resolution is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia. No. 91-16 RESOLUTION HONORING CLAREMONT CHARGES CHESS TEAM WHEREAS, the Virginia State Chess Champions, Claremont Chargers, recently competed in the National Elementary Chess Championships in Rye, New York against 1,113 students from 33 states; and WHEREAS, the Claremont Chargers finished in 4th place in the primary division against 402 students from 107 schools; and WHEREAS, the Claremont Chargers 4th Place team includes Todd Southern, B. J. Southern, Bradley Talley, Katy Talley, Seth Davis and Adam Zel, and WHEREAS, in the Individual category, Seth Davis and Adam Zel finished in 10th Place and 16th Place, respectively. NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on May 7, 1991, that the Town Council should and hereby congratulates the Claremont Chargers, who brought national recognition to themselves, their school and the Town of Pulaski. This resolution is effective upon adoption and is adopted by recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 7th day of May, 1991. Mr. Holycross requested an Executive Session on a personnel matter and also on a legal matter. At 4:35 p.m. Councilman Crispin made a motion that Council go into Executive Session under 2.1-344 Al personnel matter and two legal matters A7, seconded by Vice Mayor Neighbors and carried on the following recorded vote: Charles D. Glenn - Aye At 5:20 p.m. Council returned to regular session and waived reading of the Certification Resolution on motion made by Councilwoman Holston, seconded by Councilman Crispin and carried. Hancock - Aye CERTIFICATION RESOLUTION Whereas, the Pulaski Town Council has convened an executive meeting on this date pursuant to an affirmation recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and, WHEREAS, 52.1-344.1 of the Code of Virginia requires a certification by this Pulaski Town Council that such executive meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Pulaski Town Council hereby certifies that, to the best of each member's knowledge, {i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii} only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Pulaski Town Council.
