Minutes of the regular meeting of the Pulaski Town Council held May
21, 1991, at 7:00 p.m. in the Council Chambers in the Municipal
Building.

The Pledge of Allegiance was led by Councilman J. R. Schrader.
The Invocation was given by Councilman Robert N. Glenn.
After the roll call, Councilwoman Holston so moved that the minutes
of the regular meeting of May 7, 1991, be approved as submitted,
seconded by Councilman Crispin and carried.
Mayor Hancock welcomed visitors and advised that first on the
agenda was registered speaker, Mrs. Joan Meadows.
WATER Mrs. Meadows stated that the Town was charging landowners for water
ills from their tenants. A tenant moved out owing a water bill of $105

and the Town would not turn water back on until the bill was paid. She
felt this was a raw deal.
Mrs. Meadows was referring to an ordinance adopted in November,
1988, after a public hearing, related to water and sewer connection and
service charges (Section 17-3 (b). It holds a property owner and lessee
jointly and severally liable for water and sewer billing. The State
Code does provide for an ordinance such as this.
Mayor Hancock advised that Council did not know that the policy had
not been enforced by the Treasurer's office. It was only enforced a few
weeks ago. He further stated that the Town Council had discussed this

matter twice this week and it was felt it should be returned to the
Ordinance Committee for further review.
Councilman Graham made a motion that ordinance be referred back to
the Ordinance Committee for further review and recommendations brought
back to Council. Motion was seconded by Councilman J. R. Schrader.
Mr. and Mrs. Draper, Bobby Jones, Ferd Harvey, Polly Mitchell,
Charles Rhett, Helen Crumbley, Donna Macy, Patsy Whitaker, Barbara Tuck,
and Dan Meadows spoke in opposition to this method of collecting water
bills from rental property owners. They felt it unfair and a committee
will be formed to meet with the Ordinance Committee to work for a
possible solution.
Ordinance Committee Chairman W. H. Schrader advised that the
committee would meet Tuesday, May 28 at 4:00 p.m.
Motion then carried.
Mayor Hancock then called for Council committee reports.
PUBLIC & PERSONNEL RELATIONS, NOMINATING COMMITTEE

Chairwoman Copenhaver was absent, however, Mr. Holycross reported
that the committee had met May 14, 1991, in Executive Session.
FINANCE COMMITTEE
Chairman Neighbors reported that Council had been meeting and
working on the budget. A public hearing on the budget has been
scheduled for June 4, 1991, at 4:00 p.m. Copies of the proposed budget
are located in the Town Manager's office if citizens would like to
review.
UTILITIES COMMITTEE
WATER Chairman Graham advised that the Utilities Committee met jointly
TANKwith the Public Operations Committee on May 15, 1991. He stated that
the Health Department had ordered the Engineering Department to modify
the design of the Route 11/Peppers Ferry Road Water Tank. Amendments to
the project totaled $.37,403.80 for a total project cost of $397,083.80.
Chairman Graham made a motion that the requested change orders be
approved and the Town Manager authorized to proceed with the awarding of
the contact for the water tank, seconded by Vice Mayor Neighbors and
carried on the following recorded vote:

- Chairman Graham also requested an Executive Session as he had a
legal question.

ORDINANCE COMMITTEE
Chairman W. H. Schrader had no report.
PUBLIC OPERATIONS COMMITTEE
Co-Chairman Holston reported that the Public Operations Committee
had met jointly with the Utilities Committee on May 15, but they did not
have a report. A meeting was scheduled for Thursday, May 23 at 4:00
p.m.
MAYOR'S REPORT
Councilman Mayor Hancock advised that former Councilman Bill Macgill had
passed away. He requested that the Town Attorney prepare a Resolution
honoring Mr. Macgill to be presented to his family and it might also be
appropriate for the Council to make a contribution as a token of
Council's appreciation for his year's of service to the community.
TOWN ATTORNEY'S REPORT
Mr. Terwilliger had no report
TOWN MANAGER'S REPORT
Mr. Holycross updated Council on the Wythe County Landfill. They
have two sites #39 and alternate #40 under consideration. The
Landfilljurisdictions picked site #40, which drains away from Peak Creek, for
(Wythe) further testing and a preliminary report will be sent to Mr. Holycross.
Mr. Holycross also reported that a public hearing will be held
during the June 4th Council meeting on a request by Charles Hamilton,
Jr. to install a 36 inch drain pipe that will encroach approximately 10
feet into the undeveloped right-of-way of 6th Street, S.W. between
Washington Avenue and Upland Drive.
It was also reported that the Town Offices would be closed on
Monday, May 27 for the Memorial Day Holiday.
Ordinance No. 91-10 extending the deadline for the payment of real
estatetaxes was presented for Council's consideration. Vice Mayor
Neighbors Neighbors so moved that reading of the ordinance be waived,
seconded by Councilwoman Holston and carried.

ORDINANCE 91-10
EXTENDING TIME FOR IMPOSITION OF
PENALTIES AND INTEREST FOR LATE
PAYMENT REAL ESTATE TAXES
WHEREAS, there has been a delay in the mailing of tax assessment
notices to the owners of real estate in the Town of Pulaski; and

NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of
Pulaski, Virginia, sitting in regular session on May 21, 1991, that the
time for the imposition of penalties and interest for the late payment
of real estate taxes due on June 5, 1991, be and hereby is extended from
June 6, 1991 to June 18, 1991.
This ordinance is effective upon adoption and is adopted by
recorded vote of the Town Council of the Town of Pulaski, Virginia, on
this 21st day of May, 1991.
A Resolution was also presented honoring Pulaski Middle School -
Knowledge Master Open. Councilman Graham so moved that reading of the
resolution be waived, seconded by Councilwoman Holston and carried.
Councilman Crispin so moved that Resolution be adopted, seconded by
Councilman J. R. Schrader and carried.
RESOLUTION N0. 91-17
RE4OLUTIQN HONORING PULASKI MIDDLE SCHOOL - KNOWLEDGE MASTER OPEN
ADdPTED
WHEREAS, eleven Pulaski Middle School students placed fourth among
49 Virginia schools in the Knowledge Master Open, a computerized
academic contest which recognizes academic achievement and creates
interest in computers; and
WHEREAS, the Pulaski team consisted of Jack Warburton, Lee Eure,
Georgie Aust, Ashley Sypniewski, Robyn Nunley, Ryan Nunley, Jeannie
Hagee, Anthony Yoder, Jessica McGlothlin, Allison Sadler and Christopher
Sumner.
WHEREAS, the Pulaski team exceeded the national average in the
Knowledge Master Open, which included students from all 50 states,
Canada, Mexico, Africa, Asia, Europe and South America.
NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of
Pulaski, Virginia, sitting in regular session on May 21, 1991 that the
Town Council should and hereby commends the Pulaski Middle School
students for their fourth place finish in the Knowledge Master Open.
This resolution is effective upon adoption and is adopted by
recorded vote of the Town Council of the Town of Pulaski Virginia on
this 21st day of May, 1991.
At 8:30 p.m. Councilman Crispin made a motion that Council go into
Executive Session under 2.1-344 Al Personnel and a legal matter A7,
seconded by Vice Mayor Neighbors and carried on the following recorded

of the Certification Resolution on motion made by Councilman W. H.
Schrader, seconded by Vice Mayor Neighbors and carried.

CERTIFICATION RESOLUTION
WHEREAS, the Pulaski Town Council has convened an executive meeting
this date pursuant to an affirmation recorded vote and in accordance
the provisions of the Virginia Freedom on Information Act; and,
WHEREAS, 52.1-344.1 of the Code of Virginia requires a
certification by this Pulaski Town Council that such executive meeting
was conducted in conformity with Virginia law;
NOW, THEREFORF~, BE IT RESOLVED that the Pulaski Town Council hereby
certifies that, to the best of each member's knowledge, (i) only public
business matters lawfully exempted from open meeting requirements by
Virginia law were discussed in the executive meeting to which this
certification resolution applies, and (ii) only such public business
matters as were identified in the motion convening the executive meetin
were heard, discussed or considered by the Pulaski Town Council.
At 8:48 p.m., Councilman Graham made a motion to adjourn, seconded
by Councilman Crispin and carried.
