HomeMy WebLinkAbout2006-32• Ordinance 2006-32 Ordinance Amending Article V of the Code of Ordinances of the Town of Pulaski, "Curfew of Minors" ~i Adopted: November 7, 2006 Effective: November 7, 2006 • ORDINANCE 2006-32 • ORDINANCE AMENDING ARTICLE V OF THE CODE OF ORDINANCES OF THE TOWN OF PULASKI, "CURFEW OF MINORS" WHEREAS, The Town Council of the Town of Pulaski has considered the advice and comments of law enforcement and the Judiciary and determined it to be in the best interest of its citizens and in accordance with the health, safety and general welfare of the Town of Pulaski; and NOW THEREFORE be it hereby ORDAINED by the Town Council of the Town of Pulaski, Virginia that Article V of the Code of Ordinances of the Town of Pulaski, "Curfew of Minors", is hereby amended to read in its entirety as follows: ARTICLE V. CURFEW FOR MINORS Sec. 50-141. Generally. It shall be unlawful for any person under 18 years of age, unless on business or, to, from or during employment or school activities or accompanied by a parent, guardian or other person having the legal custody of such person to loiter in or upon the streets or other public places within the town limits at night after the hour of 10:00 p.m. Sunday through Thursday of each week and 12:00 p.m. (midnight) Friday through Saturday of each week and before the hour of 5:30 a.m. on all days during each week. Public places shall include but not be limited to private property open to the public. (Code 1990, § 11-136) Sec. 50-142. Duty of parents and guardians. It shall be unlawful for any parent, guardian or other person having the legal custody of any person under 18 years of age to allow or permit any such person who is in such legal custody to loiter in or upon any streets or other public places within the town limits in violation of Section 50-141. (Code 1990, § 11-137) Sec. 50-143. Disposal of violation. (a) Any person under 18 years of age found loitering in or upon any streets or other public places within the town limits in violation of Section 50-141 shall be deemed to be a child in need of services and dealt with in accordance with the Code of Virginia. (b) A violation of this article by a minor shall be disposed of as provided in Code of Virginia, §16.1-278.4 and 16.1-278, which said statutes shall be deemed to include community service as a punishment for any defender in the discretion of the Court hearing the matter. • This ordinance is effective upon adoption and is hereby adopted this 7tn day of November, 2006 by the duly recorded vote of the Town Council of the Town as follows: Jeffrey S.
