Jackson, presiding. Councilmen: W. S. Cummings, W. A. Larson, W. F. White, F. L. Carrico, J. W. Nash, T. J. McCarthy Councilman-elect Bill Flint Absent: J. R. Martin, Glen K. Hillsman, Chamber of Commerce Mr. Smythers The invocation was given by Town Manager Noland. Minutes of the regular meeting of July 19th were approved. Mr. Hillsman of the Chamber of Commerce appeared before " Council and outlined the Merchants' program for the up-coming "Million dollar Sale" to be held in Pulaski August 11th thru 13th, and asked Council to consider reduction in fines €or parking meter violations and taxicab fares for the three day period as the Town's and Taxicab operators' contribution to making the Million Dollar Sale a success. Mrs. Mona Leftwich petitioned Council to close Prospect Street, which runs east from Valley Road beyond Pulaski Street. She further complained of vandalism to her property in Kersey Bottom near MRS. Mr. Smythers, a resident of Birch Street, asked Council if the sewer lines would soon be extended to that Street, as he was planning to install aseptic tank if such was not the case. Town Manager Noland stated a letter had been received from the Water Control Board requesting the Town to cooperate with the Health Department in allowing persons who clean septic tanks to dump waste at the new Sewage Disposal facilities. On motion of W. S. Cummings, seconded by W. F. Aust -absent AN ORDINANCE TO^AIKEND.'•SECTIDN ~2~3-?~2 C~F_ THETOWN 'CODE.BY~ADDING A NEW SUB-SECTION 20-l~2D TO PROVIDE FOR DISPOSAL OF SEPTIC TANK WASTE IN THE TOWNS SEWAGE SYSTEM AND FOR REGULATIONS AND FEES THEREFOR. BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, THAT: 1. Waste from septic tanks and other waste of similar type collected by any person may be disposed of by depositing same in the Town's Sewer System at the Sewage Treatment Plant. 2. Disposal shall be made only at the Sewage Treatment Plant, while an operator or attendant is on duty at said Plant, or at such specific times as may be designated by the Town Manager, if, in his opinion, it becomes necessary to designate definite times. 1 1 1 `; ~~3 y Council Mins. Contd. August 2, 1960, !~ p. m. 3. The Town Manager shall make such rules or regula- tions controlling said disposal as he feels are necessary for an orderly operation. 1 !~. Fees for services performed by the Town under this Ordinance shall be based on or measured by the volume of the waste and shall be at Two Dollars for each one thousand gallon tank of fraction thereof; for tanks of more than one thousand gallon capacity, there shall be an additional charge of One Dollar for each 250 gallons of capacity or fraction thereof over the one thousand gallons. ORDINANCE Persons, or others, who dispose of waste regularly, shall, on or by the first day of the month in which they begin using the service of the Sewage Plant, deposit the sum CONTINUED of Thirty Dollars with the Treasurer of the Town. Each time a disposal is made, the proper fee shall be assessed and charged against and deducted from the deposit. The procedure for handling this shall be determined by the Town Manager. On or before the first day of each succeeding month thereafter in which services are continued, or upon the total charges equaling or exceeding the deposit, those using the service shall deposit an amount sufficient to raise the deposit to the original amount, and pay in addition any charges made over and above the $30.00 deposit. Town Manager Noland asked Council to adopt an ordinance f allowing the town to carry out radar operations for the detection of speeders, similar to those used by the State Police, and on motion of W. Aust - absent AN ORDINANCE ~R.OVIDING FOR THE USE OF RADIO MICROWAVE OR OTHER ELECTRICAL DEVICES TO CHECK THE SPEED ~ MOTOR VEHICLES WITHIN THE TOWN OF ADOPTION OF ORDINANCE PULASKI, VIRGINIA, THE EVIDENTIAL EFFECT THEREOF, TO PROVIDE FOR USE OF GIVING THE USE OF CITATIONS, CONDITIONS UNDER WHICH RADAR BY POLICE DEPT. ARRESTS ARE PERMITTED, NOTICE BY USE OF SIGNS AS TO SPEED LIMIT AND USE OF DEVICES, AND PRESUMPTION THAT SIGNS WERE PLACED. BE IT ORDAINED by the Council of the Town of Pulaski that from and after the passage of this ordinance, (a) The speed of any motor vehicle may be checked by the use of radio microwaves or other electrical device. The results of such checks shall be accepted as prima facie evidence of the speed of such motor vehicle in any court or legal proceedings where the speed of the motor vehicle is at issue. (b) The driver of any such motor vehicle may be arrested without a warrant under this ordinance provided the arresting officer is in uniform and displays his badge of authority; provided that such officer has observed the registration of the speed of such motor vehicle by the radio microwaves or other electrical device, or has received a radio message from the officer who observed the speed of the motor vehicle registered by the radio microwaves or other electrical device; provided in case of any arrest based on such a message that such radio message has been dispatched immediately after the speed of the motor vehicle was registered and furnished the license number or other positive identification of the v@1~ele and the registered speed to the arresting officer. Aug. 2, 1960, !~ p, m. summons to violators may be used as provided for violation of other motor vehicle ordinances within the Town ORDINANCE CONTINUED (c) No operator of a motor vehicle may be arrested under this section unless signs have been placed at the County line at the corporate limits of the Town, on the primary highways leading into the Town of Pulaski to indicate the legal rate of speed and that the speed of motor vehicles may be measured by radio microwaves or other electrical devices. There shall be a prima facie presumption that such signs were in place at the time of the commission of the offense of exceeding the legal rate of speed, and a certificate by the Town Manager as to the placing of such signs shall be admissible in evidence to support or rebut the presumption. 1 The legal rate of speed and the notice of measurement of speed by radio microwaves or other electrical devices may be posted on different signs and need not be posted on the same sign. An emergency existing, this ordinance shall be enforced from its passage. Town Attorney Moore gave the following opinion pertaining to the authority of the Town of Pulaski to participate with the employes, officers, and other town personnel in group insurance and in a ma3or medical program: "The Town has the authority to participate in an insurance program and may deduct sums from the earnings of Town personnel and may also contribute to the insurance program. "You have this authority under Section 5, Sub.-Sec. (9), (15), and (16) of the Charter, and particularly under the general statutes of the State of Virginia, Title 51-112, as amended. This section is cited in part as follows: COUNCIL ADOPTS RESOLUTION AFTER "'5.1-112. Counties, cities and towns generally. Such governing bodyrmay by such ordinance establish a fund for the payment of such pensions, including death benefits, and for the payment of such insurance and annuity premiums and charges by making appropriations out of the treasury of the county, city or town or by requiring contributions, payable from time to time through payroll deductions or otherwise, or by both, or by any other mode not prohibited by law......" On motion of W. A. Larson, seconded by T. J. McCarthy, and x on the following recorded vote, the following resolution was adopted: WHEREAS, the employees and other personnel of the Town of Pulaski, Virginia, as a group do now participate in group medical insurance, and have now indicated their desire as a group to obtain a ma3or medical plan offered 'by the Travelers Insurance Company in their proposal dated October 16, 1959, and amended January 8, 1960; and, W. WHEREAS, the Town of Pulaski also desires to put into operation said insurance plan for the employees, officials and the dependents of both employees and officials, as provided by the plan mentioned aforesaid, and does further desire said plan to begin as of August 1, 1960; and, WHEREAS, a sufficient number of the employees have agreed to and have subscribed as members of said insurance plan with the Travelers Insurance Company, and have authorized the Town through its proper officials to deduct from the pay of the respective employee who has become a member, the premiums necessary to meet the required cost of the insurance, for the purposes of covering their dependent and/or dependents, and such sums as they may owe on their policies; and, WHEREAS, the Council of the said Town has authorized the officials thereof to pay fifty per cent (50~) of the premium RESOLUTION for each employee, not including and hereby excepting therefrom any premium for dependents, which premiums for dependents will be paid by and will be the sole responsibility of the said employee; and, CONTINUED WHEREAS, the said Town is authorized to enter into the agreement aforesaid and to make contributions thereto, under the authority granted in its charter and under the general statutes of the State of Virginia; and, WHEREAS, Idle plan proposed requires a waiting period of three months after employment before any neW employee shall be eligible for the said plan and does provide for and set out details by which the said plan shall operate. NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Pulaski, Virginia, as follows: (1) That the plan for major medical insurance for the employees, officials, personnel, and their dependents, offered and proposed by the Travelers Insurance Company on October 16, 1959, amended January 8, 1960, copy thereof being incorporated herein and made a part hereof, be, and the same is hereby, ratified, adopted, and approved, and the proper officials of the said Town be, and they are hereby, authorized and directed to put into force as of August 1, 1960, this plan, to commence the payment of any necessary premiums for sums due in accordance with the monthly premium rates established by the said Travelers Insurance Company, to deduct sums necessary and agreed upon from employee's or officials' earnings, and, further to pay such sums from the Town's revenue as are due by the Town and to collect any and all other sums necessary from said employees for said dependents, or otherwise, and to do any and all other things necessary to put the said plan into full force and effect, and to continue it until such time as may otherwise be directed by the Town. A. Larson, and seconded by J. W. Nash, the following resolutions were made and adopted: BE IT RESOLVED, that the Town Treasurer's report for delinquent taxes for the year 1959, as certified to the Council, be accepted; that the Treasurer be credited with the amount shown to be delinquent and that said list of delinquent real estate tax be filed with the Clerk of the Circuit Court of Pulaski County, Virginia, to be recorded and indexed by him; that a list containing all unpaid real estate taxes as of June 30, 1960, be published in a local newspaper on August l6, 1960; that a list of unpaid persona; property and head taxes and arty and all other taxes be prepared; that such lists be posted at the Courthouse and other public places, all said proceedings to be in accordance with the provisions of the Code of Virginia, 1950 Edition, Title 58, Chapter 20, Article 7, and Chapter 21, Article 7 and at~y other applicable amendments to the said Code. Councilman Cummings stated he felt Council should REC. COMMITTEE TO WORK WITH consider additional recreation possibilities in the Mountain Park TOWN MGR. area, such as a swimming pool and tennis courts. The subject was PLANNING COMM.& REC. COMM. ON discussed at length, with each member of Council expressing his views. RECREATIONAL FACILITIES AT It was felt that this work could be done by town forces and that a ARMORY SITE ON MOUNTAIN master plan of development would be necessary. On motion of T. J. McCarthy, seconded by W. S. Cummings, and carried unanimously, it was RESOLVED that the matter be referred to a proper committee to work with the Town Manager, F'1.anning Commission and the Recreation Commission in setting up and planning for recreational facilities at the Armory and bring any recommendations back to Council. TOWN MGR. DIRECTED Town Manager Noland stated there had been no response to TO TEAR DOWN SAUNDERS HOUSE ON STUART a notice in the Southwest Times concerning the condition of an abandoned AVENUE FOR SAFETY PURPOSES house on Stuart Avenue, and on motion of W. A. Larson, seconded by W. S. Cummings, and carried unanimously, it was RESOLVED, that the Town Manager is directed to have the abandoned house on Stuart Avenue town down, and the lot cleared. Councilman Larson asked that the subject of parking TRAFFIC: SITUATION on Randolph Avenue between 9th adn 10th Streets be placed on the ON RANDOLPH AVE. PLACED ON AGENDA agenda for discussion. Whereupon on motion of F. L. Carrico, and FOR DISCUSSION: SUGC~ST TREES BE seconded by T. J. Carrico, and carried unanimously, the matter was turned over to the Street Committee for investigation and recommendation. Mayor Jackson stated the Federal Aviation was desirous of closing Loving Field and inasmuch as the facilities at New River Valley Airport were now available, on motion of W. A. Larson, seconded by W. S. Cummings, and carried unanimously, it was COUNCIL AGREEABLE TO CLOSING OF LOVING RESOLVED that Loving Field be closed at the direction of FIELD UPON OPENING OF NEW RTVER.X~N the Federal Aviation Agency, upon proper notice.
