Minutes of the regular semi monthlq meeting of the
Town Council of the Town of Pulaski, Virginia, held on the 21st day of
January, 1948, at 4 p. m., in the municipal office.
Present: Mayor C. V. Jackson, presiding.

The meeting was opened with a prayer by Councilman
Carrico.

particular business, but 3ust wished to attend the meeting. Many of
the Councilmen stated they wished more of the town's citizens were
interested in attending meetings of the Council.
Tawas Manager Noland read a letter from Mr. J. Foy
Howard, addressed to the Town Council, Board of Supervisors and
the Ministerial Association, in which he called their attention to
the fact that some of our people are, or will be, in desperate need
at times and that the Welfare office, or Salvation Army cannot give
relief or help until the case comes before the Board. It was Mr.
Howard•s suggestion that same kind of an emergency relief agent be
established whereby a family in need of fuel and food can have relief
and help within a few hours, not with coney but with groceMes and
fuel. This situation was discussed and on motion of W. H. '~ysor,
seconded by I. R. Carper, it was unanimously
RESOLVED that Mayor Jackson appoint a special committee
to meet with the Board of Supervisors and Ministerial Association
in an effort to work out same solutioa~ to the problem as outlined
by Mr. Howard.

it was unanimously
RESOLVED, that appraxi.mately $300.00 of the $7,000.00
in the General Fund for Retirement Program Study, be used to secure
the services of an expert consultant on Employe Benefit Plans, to
advise Council.

heavy duty front end loader to further street improvements and the
loading of stone, shale, snow, etc., which equipment would cost
approximately $15,000., stating the loader could be purchased now,
if Council approved, and payment be taken care of from the Equipment
and Stores Fund, in the 1958-59 budget. The need of such a loader
was discussed and inasmuch as several Councilmen wished to see the
loader in operation, it was decided to have a demonstration of same,
and this matter was continued, to be carried on the next agenda.
Mayor Jackson advised Council that the New River Valley
Airport Cotmnission had filed their application with the Civil
Aeronautics Administration for Federal Aid for paving of the Airport
runway, taxiway and apron, the third increment of the Airport program
and that the estimates were based on paving of a 100•x4200• runway,,
taxiway, and 200• x 350• apron.
The Town Manager advised that the Town Planning Ccsmnissio
had made several field trips to the new annexed area with the view
of zoning this area, and that the proper procedure would be for
Council to ask the Town Planning Commission to make recamanendations
as to zoning the annexed area. On motion of W. M. Wysor, seconded
by W. A. Iax~son, it was unanimously
RESOLVED that the Town Planning Cosrnn3.ssion be asked to
make recommendations as to the zoning of the annexed area.

on motion of W. H. W~'sor, seconded by I. R. Garper, it was
unanimously
RESOLVED, that the Town Manager request Mr. Aust
not to force the issue on hia building permit application
until the Town can learn definitely whether the proposed channel
change will develop to be the proper solution of this problem.
As it was the opinion of Town Attorney Garnett Moore
that more than a quorum should be present to vote on the resolution
and adoption of the two ordinances which were presented to Council
at the January 7th meeting, relative to the Bond Issue Referendum
on April 8, 1958, Town Manager Noland again presented to Council
a resolution rescinding their adoption on August 31, 1956, of an
ordinance authorizing the issuance of $1,600,000.00 of bonds of
the Town of Pulaski to finance the cost of improv3.ng and enlarging
the Townes water supply and sanitary sewer systems and providing
for the submission of the question of issuing said bonds to the
qualified voters of said town, and an motion of J. R. Martin,
seconded by W. H. ~Tysor, it was unanimously
RESOLVED, that the resolution be adapted, as follows:
THAT CERTAIN ORDINANCE entitled:
"AN ORDINANCE AUTHORIZING THE ISSUANCE OF
$1,600,000 OF BONDS OF THE TChJN OF PUTASKI TO

and operated both a sanitary sewer system in and for said Town
suitable to collect and dispose of sewage frown the territory with-~,
in said Town, and a water supply system in and for said Town suitable
to supp],y water to the Town and its inhabitants; and,
WI~REAS, said sanitary sewer system and said water
supply system have been combined and are now operated as a
single specific undertaking within the meaning of Section
127 of the Constitution of Virginia and the.Tc~n has heretofore;,
and will hereafter derive revenue from such combined sanitary
sewer system and water supply system within the meaning of said
Section 127; and,
WHEREAS, said sanitary sewer system is no longer
adequate for the needs of said Town, and the Council deems it
desirable to enlarge and improve said sanitary sewer system
~s hereinafter set forth;
NOW, THEREFORE, BE IT ORDAT~fED by the Council of the
Town of Pulaski as follows:
Section 1. The Council of the Town of Pulaski has
ascertained and hereby determines that the public interest
requires that the sanitary sewer system maintained by the
Town shall be enlarged snd extended by the construction of_
sewer lines suitable for the collectl~ar~ of sewage from territory
within said Town and the construction and equipment of a sewage
treatment and disposal plant and intercepter outfall sewer
suitable for the treatment and disposal of such sewage, and that
it is expedient that said Town shall borrow money and issue its
bonds, as hereinafter provided, to finance the cost of such
improvements.
Section 2. In order to finance the cost of enlarging
and improving said sanitary seyrer system in the manner herein-
'hefare set forth, the Town of Pulaski shall issue its negotiable
bonds of the aggregate principal amount of $1,000,000, pursuant
to and in accordance with Article 2 of Chapter 19 of Title 15
of the Code of Virginia, 1980. Said bands shall be issued under
and in ca:cplianoe with the provisions of Clause (b) of Section
127 of the Constitution of Virginia, and, sub3ect to the
conditions prescribed by said clause, shall not be included
within the otherwise suthori~ed indebtedness of said Town.

Section 3. Said bonds shall comprise an issue of bonds
payable in annual installments on January 1 in each year as
follows:
$18,000.00 in each of the years 1960 to 1954, inclusive,
$24,000.00 in each of the years 19b5 to 1966, inclusive,
$30,000.00 in each of the years 1967 to 1968, inclusive,
$35,000.00 in each of the years 1969 to 1973, inclusive,
$39,000.00 in each of the years 1974 to 1978, inclusive,
$40,000.00 in each of the years 1979 to 1980, inclusive, and
$44,000.00 in each of the years 1981 to 1988, inclusive.
Said bonds shall bear interest from their date at a rate which
shall not exceed six per centum (6~b) per annum, and such
interest shall be payable semi-annually on January 1 and
July 1.
Section 4. Said bonds shall be general obligations
of the Town of Pulaski and shall be issued upon the credit
and in the name of said Town.
Section 5. Acting pursuant to Section 15-600 of
the Code of Virginia, the Council of said Town shall contract
and agree with the purchasers of said bonds, and with each
person, firm or corporation which may hereafter become the
holder of any of said bonds or of any of the interest coupons
representing interest~.payable thereon, that, until all of said bonds
have been fully paid and discharged in accordance with their
terms, (1) the said Town will charge rates or fees for services
rendered by said sanitary sewer system and water sypp]„q
system; and, (2) such rates or fees shall be fixed and
maintained at a level which will produce sufficient revenues
under the requirements of clause (b) of Section 127, of the
Constitution of Virginia, to prevent said bonds from being
included in determining limitations of~the power of said
Town to incur indebtedness, that is to say, sufficient
revenues to pay for the coat of operation and administration
of said sanitary sewer system and water supply system,
(including interest on b Duds issued therefor) and the cost
of insurance against loss by in3ury to persons and property,
and an annual amount to be placed into a sinking fund suffi-
cient to pay, at or before maturity, all bonds issued to
finance said sanitary sewer system; and (3) the revenues which
the Town derives froaa said sanitary sewer system and water
supply system in each fiscal year shall,. to the extent
necessary, be first applied to the payment of such cost of
operation and administration during such fiscal year and to
the payment of such annual amount payable in such d~iscal
year; and (4) in order to give guarantees for the faithful
observance of such stipulations, said Town shall segregate
and keep segregated, from all other funds, all revenues
derived by the Town from its operation and ownership of s€l,id
sanitary sewer system and water supply system.
Section 6. Bonds shall not be issued pursuant to
this ordinance until said bonds shall have been approved by
the affirmative vote of the ma3ority of the qualified voters
of the Town of Pulaski voting upon the question of their
issuance. The Town-Clerk is hereby directed to present
forthwith a certified copy of this ordinance to the Circuit
Court of the County of Pulaski, or to the Judge thereof in
vacation, and the said Court or Judge is hereby requested to
enter an order directing the proper election officials of the
County of Pulaski to take such steps and to provide such means
as may be necessary to submit to the qualified voters of said

to make such order as may be proper to give due publicity
to such election.
Section 7. This ordinance shall take effect
immediately upon its adoption.

maintained and operated both a sanitary sever system in and
for said Town suitable to collect and dispose of sewage from
the terx~ttory within said Town, and a water suppl,Y system in
and for said Town suitable to supply water to the Town and
its inhabitants; and,
WHEREAS, said sanitary sewer system and said water
supply system have been combined and are now operated as a
single specific undertaking within the meaning of Section 127
of the Constitution of Virginia and the Town has heretofore
and will hereafter derive revenue from such combined sanitary
sewer systerm and water simply system within the meaning of
said Section 127; and,
WHEREAS, said water supply system is no longer adequate
for the needs of said Town, and the Council deems it desirable to
enlarge and improve said water supply system as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED by the Council of the
Town of Pulaski, as follows:
Section 1. The Council of the Town of Pulaski has
ascertained and hereby determines that the public interest
requires that .the water supply system maintained by the Town
shall be enlarged and extended by the construction of an
impounding reservoir on Peak Creek between Little Brushy
Mountain and Chestnut Mountain and the pipes and of her

and other facilities required to connect such reservoir
with the Townes water distribution system, and that it is
expedient that said Town shall borrow money and issue its
bonds, as hereinafter provided, to finance the cost of such
improvements.
Section 2. In order to finance the cost of enlarging
and improving said water supply system in the manner herein-
before set forth, the Town of Pulaski shall issue its nego-
tiable bonds of the aggregate principal amount of $630,000,
pursuant to and in accordance with Article 2 of Chapter 19 of
Title 15 of the Code of Virginia, 1950. Said bonds shall be
issued under and in compliance wi.th•the provisions of Clause
(b) of Section 127 of the Constitution-of Virginia, and,
subject to the conditions prescribed by said clause, shall
not be included within the otherwise ar~thorized indebtedness
of said Town.

Section 3. Said bonds shall comprise an issue of
bonds payable in annual installments on January 1 in each
year, as follows:
$12,000.00 in each of the years 1960 to 1964, inclusive,
$16,000.00 in each of the years 1965 to 1966, inclusive,
$20,000.00 in each of the years 1967 to 1968, inclusive,
$24,000.00 in each of the years 1969 to 19_, inclusive,
$23,000.00 in each of the years 1970 to 1973, inclusive,

$26,000.00 in each of the years 1982 to 1988, inclusive.
Said bonds shall bear interest from their date at a rate which
shall not exceed six per cenbum (5~) per annum, and such
interest shall be payable semi-annually on January 1 and
July 1.
Section 4. Said bonds shall be general obligations of
the Town of Pulaski and shall be issued upon the credit and in
the name of said Town.
Section 5• Acting pursuant to Section 15-600 of the

said sanitary sewer system and water supply system in each
_ fiscal year shall, to the extent necessary, be first applied to tl~ pay-
ment of such cost of operation and administration during such
fiscal year and to the payment of suc~i annual amount payable in
such fiscal year; and (4) in order to give guarantees for the
faithful observance of such stipulations, said Tower shall
segregate and keep segregated, Fran all other funds, all
revenues derived by the Town fra:n its operation and ownership
of said sanitary sewer system and water supply system.
Section 6. Bonds shall not be issued pursuant to
this ordinance until said bonds shall have been approved by the
affirmative vote of the ma3ority of the qualified voters of the
Town of Pulaski voting upon the question of their issuancez The
Town Clerk is hereby directed to present forthwith a certified
copy of this ordinance to the Circuit Court of the County of
Pulaski, or to the Judge thereof in vacation, and the said Court
or Judge is hereby requested to enter an order directing the
proper election officials of the Caunty of Pulaski to take such
steps and to provide such means as may be necessary to submit
to the qualified voters of said Town the question of whether
said bonds shall be issued, and to make such order as may be
proper to give due publicity to such election.
Section 7. This ordinance shall take effect
immediately upon its adoption.
Mr. Howard Jackson, Director of Public works, appeared
late at the meeting and stated that he was very proud of the Town
Shop and facilities on Caumerce Street and that he would like to

Council agreed to the working out of plans for such an event.
