~~~~ Council Minutes Aug. 5, 1958, 4 p. m. Minutes of the regular meeting of the Town Council of the Town of Pulaski, Virginia, held on the 5th day of August, 1958, at 4 p. m., in the Municipal office. There were present: Mayor C. V. Jackson, presiding. Councilmen: W. A. Larson, J. R. Martin, W. H. Wysor, F. L. Carrico, Z. R. Carper Councilmen-elects T. J. McCarthy, John W. Aiash, Glen g. , Aust Also present: Town Manager: T. B. Noland Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Town Engineer: R. Lloyd Mathews Visitors: Evelyn S. Hall, reporter for the Southwest Timis, Various citizens of Pulaski (including 12 merc~jants) who appeared relative to the proposed cigarette tax ordinance and storm drains The meeting was called to order by Mayor G. V. Jackson, '. and Councilman Carrico gave the invocation. Minutes of a regular meeting of July 15s 1958, adjourned meeting of July 17, 1958, called meeting of July 21+, 1958, and called' meeting or July 30, 1958, were approved. The meeting was declared to be a public hearing at this MEETING DECLARED time for persons desiring to appear for or against the proposed TO BE PUBLIC budget for the year begirsning July 1, 1958 and ending June 30, 1959 ' HEARING ON PRO- POSED BUDGET said public hearing having been duly advertised in the local news- paper. , Following the Mayors invitation for anyone who wished to speak on the proposed budget, Mr. William L. OtFlaherty, represent ing the Tobacco Tax Council. of Virginia, explained that he was actin~i PROPOSED BUDGET & CIGARETTE TAX ORD. as primary spokesman for the merchants of the Town atut particularly ; DISCUSSED for those present in opposition to the proposed two cents per pack license teat on the sale of cigarettes. The spokesman cited statistiak~ gained on both a nation ride and state basis which supported his view that a local tax on cigarettes is unfair and would be detrimental. to local merchants. A considerable amount of information was gixen all of which was received by Council, and at some points direct questions were asked either by members of Council or by the delegatidn present. Mayor Jackson pointed out to the group that several years:' previous an attempt had been made by Council to raise the property Council minutes contd. Aug. 5, 1958, 4 p• m• tax rate but that the proposal had met ,with very strong opposi- tion whereupon Council had turned to the tax on the sale of cigarettes only as an alternative to an increase in the property tax rates. It was pointed out to the group t}~at there is a clear and immediate need of additional General Fund revenue because of DISCUSSION upcoming ~iighway expenditures which the Town cannot escape. Several of the individual merchants made individual CONTINUED statements in opposition to the proposed cigarette tax, after which the Mayor invited further comments from any who might wish to make same. As a result of the question from the group of citizens, it was explained that while the proposed budget included the two cent per pack cigarette license tax the Town i`ttorney would have to prepare ari ordinance far Councilts approval before the machinery for collecting the tax could be set up. There having appeared no persons to be heard for or against the proposed budget, except as it pertained to a license tax on cigarettes, on motion duly made by W. A. Aug. 5, 1958,~i4 p.m. A number of citizens present indicated they had;: come in interest of storm drain improvements, particu~iar- ly in the area at the intersection of Washington Avenue and Fourth Street. The Town Manager stated that as a result of *' previous instructions of Council an extensive study had been made of this problem and suggested that the " Manager's report be given in the presence of the group of citizens, which plan was agreed to. A map was displayed on which was shown the alig~'1- went, grades, and sizes of the storm sewer system in . the ~ourth Street-Coleman Furniture area, between TOWN MGR. OUTLINES PLAN FOR COR. Jefferson and Madison Avenues. The idanager stated that STORM DRAINAGE FOURTH & WASH. AVE. in view of the study made by the I'~epartment of Public? Works and himself it seemed that a considerable degree of flood relief could be obtained by deepening and and widening the open ditch from a point between Bageant Chevrolet and Coleman Furniture eastward to Madison Avenue and by the placing of an additional and larger drain pipe from Washington Avenue to the open drain referred to above. It was reported that as a result of the very heavy rain which had fallen on the Saturday night ~yY RAZNS previous to the meeting, a box culvert at the inter- '~'! DRAINAGE repairs were necessary. Aug. 5, 1958, 4 p. m. It was stated that at this point a close estimate $3,000. APPROPRIATION FOR REPAIR TO CULVERT DORA HW7C. AND PROPOSED DRAINAGE PROBLEM NTH & WASB. AVE. of the cost of repairing the culvert and making the suggested storm drain improvements in the vicinity of Washington and Fourth, a rough estimate of the cost of both projects would be 53,000. whereupon on motion of W. Lemons - absent -absent W. S. Cummings - absent RESOLVED, that the sum of 53,000.00 be appropriat- ed from the General Fund to take care of the emergency storm sewer repairs. On motion of J. R. White -absent W. S. Cummings - absent BE IT RESOLVED, that an ordinance amending ADa'TION OF ORD. AMENDING cAAPTER 3, SEC. 1 OF LICENSE CODE ORDINANCE Chapter 3, Section 1 of the License Code of the Town of Pulaski so as to provide for an increase in the levy and collection of a license tax on motor vehicles, trailers, ~ semi-trailers, etc., in the Town of Pulaski, Virginia, is hereby adopted, as follows: AN ORDINANCE AMENDING CHAPTER 3, SECaON 1 OF THE LICENSE CODE OF THE TOWN OF PULASKI SO AS TO PROVIDE FOR THE LEVY AND COLLECTION OF A LICENSE TAX ON MOTOR VEHICLES, TRAILERS, SEMI- TRAILERS, ,ETC., IN THE TOWN OF PULASKI, VIRGINIA. CHAPTER 3 1. The license tax to be paid by the owner of motor vehicles hereinafter mentioned shall be as follows: (a) PASSENGER AUTOMOBILES. On every passenger automobile, station wagon, hearse, and ambulance not used for hire, a license tax of 510.00. 1 Council minutes contd. ~~f'~ f~ ~.~, i Aug.S, 1958, On every such vehicle described above and used for hire, there shall be a tax of 504 per hundred pounds of weight or fraction thereof, as determined by the manufacturer's shipping weight. Such tax shah not be in lieu of any other license acquired under provisions of Chapter 1 of License Tax Ordinance. (b) MOTORCYCLES, MOTORBIKES & MOTORSCOOTERS. On every motorcycle, motorbike and motor scooter, the tax shall be 53.00, with 51.00 additional for each side car or delivery box. (c) BUSSES & JITNEYS. On every motor vehicle operated as a bus for the transportation of pass- engers for hire, or otherwise, the licensC? tax shall be 404 per hundred pounds of weight or fraction thereof, as determined by manufacturer's shipping weight, and such tax shall not be in lieu of any other license acquired under prov- visions of Chapter 1 of the License Tax Ordinance. (d) TRUCKS AND TRACTORS. On every truck or ORDINANCE tractor not used for hire, the license tax based on the gross weight when loaded to capacity shall CONTINUED be assessed according to the following schedule: • 10,000 lbs. or less - a minimum of 510.00, and for each one hundred pounds addl. above 10,001, to 30,000 lbs., there shall be a tax of 154 per one hundred pounds of gross weight. and for each one hundred pounds additional above 30,000 lbs. there shall be a tax of 204 per hundred pounds df gross weight. (e) TRUCKS & TRACTORS USED FOR HIRE. On every truck or tractor used for hire, the license tax based on the gross weight when loaded to capacity shall be assessed according to the following schedule: 10,000 lbs., or less - a minimum of 517.50, and for each one hundred pounds additional above 10,001, to 30,000 lbs., there shall be a tax of 204 per one hundred pounds of gross weight, and for each one hundred pounds additional abollte 30,001 lbs., there shall be a tax of 254 $er • one hundred pounds of gross weight. (f) TRAILERS & SEMI-TRAILERS. On every trailer or semi-trailer not used for hire, the license tax shall be one-half (~) of the license tax provided in Sub-section (d) for trucks of like capacity, and on every trailer or semi-trailer used for hire, excepting those operating as common carriers under certificate issued by the State Corporation Commissio! the license tax shall be one-half (~) the license tax: provided in Sub-section (e) for trucks of like ` capacity used for hire. ~~~.~~~ ~~~~t~~~ Council minutes contd. Aug. 5, 1958 (g) TRACTOR TRUCK & TRAILER OR SEMI-TRAILER COMBINATION. In the case of a combination of a tractor-trailer and a trailer or semi-trailer, each vehicle constituting a part of such t~ombination shall be licensed as a separate vehicle, and separate license plates shall be issued therefor, but, for the purpose of determining the gross weight group into which any such vehicle falls pursuant to sub-section (d) and (e); the combination of ORDINANCE vehicles of which vehicle constitutes a part shall be considered a unit and the aggregate gross weight of CQNTINUED the entire combination shall determine such gross weight group, and the tax computed under sbhedule subsections (d) and (e) . The license tax for a tractor truck shall be 522.00 for such vehicle not used for hire, and 533.00 for such vehicle used for hire, and such tax shall be deducted from the gross weight tax for the combination of the tractor-trailer and trailer or semi-trailer, and such difference shall constitute the license tax applicable to the trailer or semi- trailers. (h) TRAILERS & SEMI-TRAILERS - PRIVATE. On one or two wheel trailers, with body length not more than six (6) feet, width not exceeding the width of the car's maximum capacity, not to exceed 1,000 pounds, to be attached to applicant's own automobile or tractor, and not to be used for carry- ing fir©duc~, freight, or property for other than the owner, the license tax shall be 53.00. On every trailer or semi-trailer designed and used for transportation of passengers, or equipped for living quarters, and not used for hire, the license tax shall be 55.00. On motion of T. R.
